Title

Analysis

This resolution authorizes acceptance of Sewer Easement SE-2911 and Release of Sewer Easement SER-2907 located between East Kenwood Boulevard at a point approximately 760-feet east of North Lake Drive to East Hampshire Street at a point approximately 735-feet east of North Lake Drive, in the 3rd Aldermanic District.

 

Body

Whereas, The City of Milwaukee (“City”) was granted Sewer Easement SE-330 by Gertrude S. MacLaren in a document recorded on November 9, 1937 with the Milwaukee County Register of Deeds for access to and maintenance of a sewer located between E. Kenwood Boulevard at a point approximately 760-feet east of North Lake Drive to East Hampshire Street at a point approximately 760-feet-east of North Lake Drive, in the 3rd Aldermanic District; and

 

Whereas, Andy Nunemaker now owns the land and desires to build a structure over the existing sewer easement; and

 

Whereas, There is an existing 8-inch diameter public sanitary main sewer in said sewer easement; and

 

Whereas, it was determined that a sanitary sewer main relocation and relay is necessary to accommodate the proposed structure and relocated City of Milwaukee sewer facilities. Release Of Sewer Easement SER- 2907 releases Sewer Easement SE-330, which includes the existing 8-inch sewer that will be abandoned as part of the sewer main relocation; and

 

Whereas, the land owner is willing to grant Sewer Easement SE-2911, which will include said sanitary sewers and also give the City permission to enter the property, and to construct, operate, maintain, inspect, and repair all sewer facilities within the easement area on terms and conditions negotiated by the City’s Department of Public Works, as reflected in the easement document that has been made part of this file; and

 

Whereas, The City will release SE-330 as it is replaced by the new Sewer Easement SE-2911; now, therefore, be it

 

Resolved, by the Common Council of the City of Milwaukee, that the proper City officials, including the DPW Commissioner, are hereby authorized: (i) to sign Sewer Easement and Release of Sewer Easement in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution); and (ii) to sign the easement and cause the same to be recorded in the Milwaukee County Register of Deeds Office.
