Title
Substitute resolution authorizing an amendment to the Water Service Agreement with the City of Wauwatosa relating to the transfer of certain customers currently receiving water service from the Milwaukee County Grounds to receive water service from the City of Wauwatosa.
Analysis
This resolution provides for the transfer of certain customers currently receiving water service from the Milwaukee County Grounds to receive water service from the City of Wauwatosa. The change is related to the transfer of water facilities from Milwaukee County to the City of Wauwatosa and to the Milwaukee Regional Medical Center. The change will be formalized in an amendment to the Water Service Agreement with the City of Wauwatosa authorized by this resolution.

Whereas, The Milwaukee Water Works has water service agreements with the City of Wauwatosa and Milwaukee County for the provision of water at wholesale; and
Whereas, The Milwaukee County does not operate as a community water system and wished to transfer ownership of water facilities to the Milwaukee Regional Medical Center; and
Whereas, Milwaukee County currently purchases water from Milwaukee at two metered connection points located at (1) Elm Spring Avenue and Wisconsin Avenue and (2) West North Avenue and North 60th Street; and
Whereas, Due to their geographical location of the properties and configuration of water infrastructure connections, properties served by Milwaukee County could receive water service from the Wauwatosa Water Utility without construction of new water facilities; and
Whereas, In a Final Decision dated July 8, 2021 in Docket 5-BS-253, the Public Service Commission of Wisconsin authorized Wauwatosa to acquire existing water facilities from Milwaukee County to provide water service to the MRMC campus, seven additional new customers currently served by Milwaukee County, and approximately 150 residential and commercial customers along North Avenue who are also currently served by Milwaukee County; and
Whereas, While the water provider to these properties would transfer from Milwaukee County to the Wauwatosa Water Utility, Milwaukee Water Works would remain the wholesale water provider and the amount of water sold by Milwaukee Water Works would not change; and
Whereas, Milwaukee Water Works has water service agreements with both Wauwatosa and Milwaukee County that delineate each wholesale customer's service area, which agreements would require amendment to be executed to redefine the service area; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, That the proper city officials are directed to execute an amendment to the water service agreement with the City of Wauwatosa, in substantially the same form as the amendment attached to and made part of this file, to permit Wauwatosa to purchase water from Milwaukee at the Additional Connections for service to the Additional Customers; and, be it
Further Resolved, That the Milwaukee Water Works shall file with the Public Service Commission of Wisconsin, a fully-executed copy of the amendment to the water service agreement with the City of Wauwatosa.
