Title

Substitute motion establishing a procedure for allocating a portion of the funds provided under the American Rescue Plan Act.

 

Analysis

This motion establishes a process for the allocation of the first tranche of funds to be received under the American Rescue Plan Act. 

 

Body

 

It is moved, By the Common Council of the City of Milwaukee, that the following procedure shall be used for the allocation of the first tranche of funds provided under the American Rescue Plan Act.

 

1.                     Common council members shall submit requests for American Rescue Plan Act allocations to the Office of the Common Council - City Clerk no later than 5:00 pm on Friday, October 1, 2021.  Allocations submitted previously to the Common Council as resolutions need not be re-submitted.

 

2.                     Requests shall be prepared in the order received and submitted to the Department of Administration - Budget and Management Division and the Office of Equity and Inclusion for comment.  Allocations submitted as resolutions and deemed timely filed shall be referred to the Department of Administration - Budget and Management Division and the Office of Equity and Inclusion for comment.

 

3.                     A compilation of all requests shall be made publicly available no later than Tuesday, October 12, 2021.

 

4.                     The Finance and Personnel Committee shall schedule a special meeting to take up all requests submitted until par. 1.  Amendments shall be taken up by department affected, departments being sorted by alphabetical order.  The Finance and Personnel Committee shall submit its recommendations to the Common Council.  Given the $3.8 million previously allocated to the “Earn and Learn” program, these recommendations may not exceed $193 million.

 

5.                     When the recommendations created in par. 4 are reported to the Common Council by the Finance and Personnel committee, the council shall first consider any requests recommended for adoption by the committee, in order by department affected.

 

6.                     The Common Council shall next consider any requests which were submitted for consideration to the Finance and Personnel Committee but which were not recommended for adoption by the committee, provided they were submitted to the city clerk at least 24 hours prior to the council meeting, in order by budget item affected.

 

7.                     The Common Council may next, by a non-debatable two-thirds vote of the members of the council in office at the time of the vote, accept for consideration any request which was not submitted under either par. 5 or 6.

 

8.                     All requests shall specify the changes in amounts and positions as the result of the requests.

 

9.                     Amendments to requests may be offered to the Common Council, provided they are germane. All amendments to requests shall be prepared in the form of a substitute to the original. Such substitute amendments shall not require a separate motion to accept the amendment for consideration in lieu of the original.  If a motion to adopt such a substitute amendment fails, the question before the council shall be the adoption of the original amendment.

Further moved, That Common Council File Number 210576 is rescinded; and, it is

 

Further moved, That the foregoing shall not apply to the following three items in the Mayor’s American Rescue Plan Act Milwaukee Recovery and Resilience Plan released July 13, 2021:

 

1.                     Milwaukee Emergency Medical Services Augmentation Project.

2.                     Reckless Driving Initiative.

3.                     Eviction Prevention - Milwaukee Right to Counsel.
