Analysis

This resolution authorizes the Commissioner of Public Works to execute a project agreement titled “Cost Sharing Memo of Understanding Between the City of Milwaukee and the City of West Allis” for the cost sharing of the preliminary design and plan preparation for the connection between South 72nd Street and the Hank Aaron State Trail (HAST) in the 10th Aldermanic District with a total estimated cost of $38,000 of which the City’s share is $3,300 and the City of West Allis’ share is $34,700. This resolution also provides contingent authorization for City of Milwaukee conveyance to the State of Wisconsin, Department of Natural Resources, of a portion 690 South 72 nd Street.

 

Body

Whereas, The City of West Allis has requested a pedestrian and bicycle connection between South 72nd Street public right-of-way and the Hank Aaron State Trail located on the State of Wisconsin, Department of Natural Resources (DNR) land at 682 South. 76th Street; and

 

Whereas, The connection is located in the City of Milwaukee; and

 

Whereas, The City of Milwaukee will perform the preliminary design and plan preparation and City of West Allis will let the contract and perform the construction inspection; and

 

Whereas, The City of West Allis will reimburse the City Milwaukee for the preliminary design and plan preparation costs, estimated to be $3,300; and

 

Whereas, This project is anticipated for construction in 2021- 2022; and

 

Whereas, Funding for the engineering phase of the project was included in resolution 201064;

 

now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public works is hereby authorized to execute the project agreement titled “Cost Sharing Memo of Understanding Between the City of Milwaukee and the City of West Allis” that is part of this file, or one in substantial conformity thereto, for the City DPW to perform the field data and design work associated with the connection; and be it

 

Further Resolved, that contingent upon the State DNR contractually agreeing with the City of West Allis to allow the state-owned lands for construction of the connection, with that construction being at West Allis expense, and not at City of Milwaukee expense, and upon City of West Allis committing with the State DNR to construct the connection, then, the proper City of Milwaukee Officers and employees are authorized to convey to the State DNR, at no cost, on an AS IS, WHERE IS basis, by Quit Claim Deed and without representation or warranty, that portion of the City-owned land at 690 South 72      nd Street depicted in the map that is part of this file (or such lesser portion of that portion as may be necessary for the connector as DPW shall reasonably determine) in order that the connector may be constructed and installed by the City of West Allis.
