Title

Resolution authorizing the Commissioner of Public Works to execute Project Agreements titled “State Municipal Agreement for a Transportation Alternatives Program (TAP) Project” with the Wisconsin Department of Transportation and to set up design engineering at a total estimated cost of $260,060 with an estimated City of Milwaukee share of $52,012 and a grantor share of $208,048 for two projects.

 

Analysis

This resolution authorizes the Commissioner of Public Works to execute Project Agreements with the Wisconsin Department of Transportation for the planning, design and construction of two Transportation Alternatives Program projects. This resolution also directs the City of Milwaukee Comptroller to transfer funds and establish project grant chartfield values for the planning and preliminary engineering for these projects. The Project Agreement provides for 80 percent Federal aid and 20 percent local funds. The total estimated cost of the two projects is $1,823,953 with a grantor share of $1,459,162 and a City share of $364,791. The total estimated planning and preliminary engineering cost for the two projects is $260,060, with a grantor share of $208,048 and a City share of $52,012. Construction funds for these projects will be included in future resolutions. 

 

Body

Whereas, the project agreements have been requested and received from the Wisconsin Department of Transportation to be executed by the City of Milwaukee for programming, planning, design and construction of the following projects under the Transportation Alternatives Program (TAP):

20th St Power Line and Beerline Trail

Olive St to Villard Ave & 24th St to 20th St

 

Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee of project cost overruns and changes in scope approved by the Department of Public Works; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100 percent liable for project cost overruns and changes in scope as approved by the Department of Public Works; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; and

 

Whereas, Construction on these projects is currently scheduled to start in 2022-2024; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is hereby authorized to execute the Project Agreements for the programming, planning, design, and construction of the aforementioned projects with Federal aid under the Transportation Alternatives Program, copies of which is attached to and incorporated in this resolution by reference as though set forth in full; and, be it

 

Further Resolved, That the proper City of Milwaukee official is hereby directed to undertake preliminary engineering for the above-mentioned project which is anticipated to begin in 2021 and to reimburse the Wisconsin Department of Transportation for preliminary engineering costs they incur for the improvements; and, be it

 

Further Resolved, That the Commissioner of Public Works is hereby directed to undertake, or engage a consultant to undertake, all or part of the engineering for the improvement of the aforementioned projects and to reimburse the Wisconsin Department of Transportation for the design engineering costs as they occur for the improvements; and, be it

 

Further Resolved, That minor changes to the agreement which do not change its intent are hereby approved; and, be it

 

Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project Grant Chartfield Values for design engineering for the projects (Expenditure) and transfer to any of these accounts the amount required under the grant agreement and the City Accounting Policy but not to exceed a 10 percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:
