Analysis
This resolution directs the City Attorney to provide quarterly reports to the Common Council on the development and implementation of risk management strategies.
Body
Whereas, The 2021 City Budget was adopted by Common Council File Number 200001 on November 24, 2020; and
Whereas, Amendment 7 to the 2021 Budget placed a footnote in the Budget stating, “The City Attorney shall report to the Common Council quarterly on the development and implementation of risk management strategies; and
Whereas, Engaging in risk management strategies enables an organization to minimize negative and maximize positive impacts in the pursuit of its goals and mission; and
Whereas, Two Risk Management Specialist positions were added to the Fire and Police Commission by Common Council amendment in the 2018 Budget, with the two positions eventually reclassified as Risk Manager and Auditor; and
Whereas, These two positions were initially intended to focus on the Police Department’s implementation of policies and procedures, discover actual practices that result in mounting litigation and settlement costs, and recommend potential policy and training procedure changes to the Commission; and
Whereas, Amendment 9 of the 2021 Budget created a footnote stating, “move the position authority, FTE and funding for the Risk Manager position in the Fire and Police Commission to the City Attorney’s Office. Retitle the position as ‘Risk Manager’”; and
Whereas, The City Attorney’s Litigation and Risk Management Section provides defense representation for all City departments, related City entities, City officials, officers, and employees in civil lawsuits brought under federal and state law; and
Whereas, The Litigation and Risk Management Section also pursues and defends against appeals of judicial and jury determinations in litigation in both the state and federal appellate courts as well as the supreme courts in both systems; and
Whereas, The City Attorney’s quarterly reports will provide the Common Council with a clear sense of the effectiveness of risk management strategies throughout various City departments and an opportunity for the Common Council to identify areas for improvement and express interest in additional risk management strategies; now, therefore be it
Resolved, By the Common Council of the City of Milwaukee, that the City Attorney shall provide quarterly reports to the Common Council on the development and implementation of risk management strategies.
