This resolution authorizes the City of Milwaukee to enter into an amendment to City Sewer Easement SE-2546 affecting 7901 N. Granville Road to accommodate green infrastructure storm water management facilities on property owned by New Testament Church of Milwaukee, Inc.
Body
Whereas, The City of Milwaukee is the holder of easement rights under City Sewer Easement SE-2546, recorded in the Milwaukee County Register of Deeds Office on Jul 23, 1992 as Document Number 6641483; and
Whereas, New Testament Church of Milwaukee, Inc. is the current owner of the property at 7901 N. Granville Road, being the property subject to the City Sewer Easement, and that owner, as successor to the grantor under the City Sewer Easement, wants the Milwaukee Metropolitan Sewerage District (MMSD), in conjunction with Corvias Infrastructure Solutions, LLC (Corvias), to have installed on the property green infrastructure to accommodate storm water run-off from West Bradley Road and to serve as storm water management facilities; and
Whereas The green infrastructure improvements involve removing 160 feet of City storm sewer and installing a connector pipe to drain storm water from West Bradley Road to the surface of the church’s property and the new constructed stormwater wetland that will be installed there as part of the green infrastructure project; and
Whereas, MMSD will pay for the costs of installing the green infrastructure project, including the removal of the 160 feet of City sewer pipe and installation of the new connector pipe, and Corvias will oversee the work; and
Whereas, MMSD, Corvias, Church and City, by its DPW, negotiated the proposed Amendment to City Sewer Easement SE-2546 that is part of this file, which amendment sets forth the duties of the property owner, MMSD, and Corvias, to install the green infrastructure project, at no cost to the City, and that allows the City additional easement rights; now therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the proposed amendment to City Sewer Easement SE-2546 that was submitted to this file is hereby approved, and City personnel, including the DPW Commissioner, are authorized: (i) to cause the City to enter that document in the same form, or in substantially the same form and substance, as has been submitted to this file; and (ii) to take such further acts as may be contemplated or required to be taken by the City thereunder so as to carry out the intent and purpose of this resolution and that document.
