Title

Resolution authorizing the Milwaukee Health Department to enter into affiliation agreements and Business Associate Agreements with various educational institutions seeking to place their students at Milwaukee Health Department sites for supervised learning experiences.

Analysis

This resolution authorizes the Milwaukee Health Department to execute affiliation agreements and Business Associate Agreements between the City of Milwaukee and area educational institutions seeking to place their students at Milwaukee Health Department sites for supervised learning experiences.

Body

Whereas, Educational institutions seek to provide, as part of their curricula, supervised site experiences for their students; and

 

Whereas, Area educational institutions seek to place their students at Milwaukee Health Department sites for such supervised learning experiences; and

 

Whereas, The Milwaukee Health Department, as part of its mission, encourages and supports training and education programs, and desires to cooperate with area educational institutions to establish education sites in Milwaukee Health Department facilities; and

 

Whereas, The Health Insurance Portability and Accountability Act of 1996 (HIPAA) imposes various requirements on health care providers with respect to the privacy and security of personal health information; and

 

Whereas, One of these requirements is that health care providers enter into agreements designated as “Business Associate Agreements” in certain instances in which they share personal health information with third parties; and

 

Whereas, The Milwaukee Health Department may share personal health information with area educational institutions, among other entities, in the course of providing clinical education sites to students; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the designated officers of the Milwaukee Health Department may enter into agreements, as approved by the Office of the City Attorney, to effectuate affiliations between the Milwaukee Health Department and educational institutions to provide education sites; and, be it

 

Further Resolved, That the designated officers of the Milwaukee Health Department may also enter into Business Associate Agreements with such educational institutions, as required by the Health Insurance Portability and Accountability Act of 1996; and, be it

 

Further Resolved, That such authority of the City of Milwaukee Health Department shall continue for five years.
