Title
Resolution expressing the City of Milwaukee's support for Wisconsin 2019 Assembly Bill 1012, relating to police use of force in Wisconsin.
Analysis
This resolution expresses the City’s support for Wisconsin 2019 Assembly Bill 1012, relating to police use of force in Wisconsin. The resolution also directs the Department of Administration - Intergovernmental Relations Division to lobby for passage of this bill.
Body
Whereas, Wisconsin 2019 Assembly Bill 1012 reforms police use of force policies by prioritizing the preservation of life and minimizing the use of force; and
Whereas, Governor Tony Evers called for local government leaders to join in demanding this change; and
Whereas, Assembly Bill 1012 requires each law enforcement agency to ensure that its publicly-available policy on the use of force incorporates the following principles:
1. The primary duty of all law enforcement is to preserve the life of all individuals.
2. Deadly force is to be used only as the last resort.
3. Officers should use skills and tactics that minimize the likelihood that force will become necessary.
4. If officers must use physical force, it should be the least amount of force necessary to safely address the threat.
5. Law enforcement officers must take reasonable action to stop or prevent any unreasonable use of force by their colleagues.

Whereas, This bill also prohibits disciplining a law enforcement officer for reporting a violation of a law enforcement agency’s policy regarding the use of force; and
Whereas, The Standard Operating Procedure for the Milwaukee Police Department currently incorporates several of the principles, including the following:
1. Section 460.15 states that the department shall “use only the force necessary to effectively maintain control of a situation and protect the safety of police and members of the public.”
2. Section 460.20 prohibits the use of deadly force as anything other than the last resort.
3. Section 460.25 requires law enforcement officers to take reasonable action to stop or prevent any unreasonable use of force by their colleagues.
4. Under s. 460.10, the department is required to comply with Wisconsin’s Defense and Arrest Tactics (DAAT).

Resolved, By the Common Council of the City of Milwaukee, that the City Milwaukee supports passage of Wisconsin 2019 Assembly Bill 1012; and, be it
Further Resolved, That the Department of Administration - Intergovernmental Relations Division is directed to lobby for passage of Wisconsin 2019 Assembly Bill 1012; and, be it
Further Resolved, That the City Clerk shall send copies of this resolution to the City’s delegation in the State Legislature; and, be it
Further Resolved, That File Number 180898 is amended by inserting the following item in the document attached to the file and identified as “AMENDED 2019-2020 State Legislative Detailed Proposals and Key Issues”:
