Minutes note: The court reporter was sworn in. The question was put: Have the members of the Common Council read the Report and Recommendations of the Licenses Committee and the exceptions filed in these matters? All members present indicated that they had done so; Ald. Davis EXCUSED, Ald. Zielinski ABSENT. (Ald. Davis later asked for unanimous consent to be recorded as having read the report. There was no objection.) The question was put: Is Robert Griffin or his counsel present and, if so, does he wish to address the Common Council? There was no response. Ald. Donovan's motion: Amend the Class "B" Tavern, Tavern Dance, and Billiard Hall applications of Manuel J. Mendez for the premises at 3235 W. Scott St. ("The Last Chance") to add "fitness of location" as a grounds for nonrenewal. Ald. Donovan moved that the Common Council resolve itself into a Committee of the Whole for the purpose of hearing from the office of the City Attorney on this matter. There was no objection. Asst. City Attorney Bruce Schrimpf appeared and addressed the Common Council. Ald. Donovan withdrew his amendment. Ald. Donovan moved that the Committee rise. There was no objection. Mr. Robert Griffin later appeared. Ald. Bohl moved that the Common Council resolve itself into a Committee of the Whole for the purpose of taking testimony in this matter. Mr. Robert Griffin appeared and addressed the Common Council. Asst. City Attorney Bruce Schrimpf appeared and addressed the Common Council. Ald. Bohl moved that the Committee rise. There was no objection. Ald. Hamilton moved that Mr. Griffin's license application be held one cycle to permit Mr. Griffin to pay an outstanding judgment against him.

Arena says that Mr. Mendez is withdrawing the Tavern Dance application and wants to amend his location name to "El Socolo". Ald. Scott St. He says that he previously testified about the problems caused by the tavern when it was open under Mrs. Mendez and he says that the neighborhood has not experienced problems since the tavern has been closed. Mr. Gonzales, Jr. points out a couple of questions on the alcohol beverage application that he feels were answered falsely or incompletely by the applicant. He also says that he was threatened with a gun by Mr. Mendez outside of his home. Ald. Kovac moves to make the criminal complaint against the applicant filed in circuit court part of the record. She says that she moved back to the area in March because the bar was closed. Jose Castillo, 3218 W. Scott St., is in objection to the license. Neighborhood supporters: Steve Youngman, 1315 S. 33rd St., says that he has had positive experiences with Mr. Mendez and says that the applicant is very responsive to problems at his business, such as graffitti. Jorge Cerna, 1222 S. 33rd St., says that he was present at the incident involving Mr. Gonzalez, Jr. and says that Mr. Mendez did not have a gun during the altercation and that he did not hear Mr. Mendez threaten Mr. Gonzalez, Jr. Catarino Cerda, 3223 S. 7th St., is in support of the applicant. Pedro Daleccio, 1207 S. 33rd St., says that he has not experienced any problems with the establishment and is in support of the applicant. Victor Colon, 2916 N. Holton St., owns a business in the area and says that he has never seen any gang activity at the location. Blas Cerda, 2214 S. 14th St., knows the applicant very well is in support of the license. Porfirio Ventura, 3334 W. Scott St., is in support of the license. Oliva Arias, 2307 S. 9th St., is in support of the license. Ondina Andino, 1219 S. 33rd St., is a neighbor in support of the license. Capt. Gaglione says that he has received calls from neighborhood residents indicating happiness that the bar has been closed. He says that he does not think that the neighborhood would be well served by the tavern re-opening. Ald. Donovan asks the committee to consider not granting the license because he does not think the tavern is good for the neighborhood. Mr. Mendez says that he will remove the jukebox from the bar and will get more help with checking IDs in the tavern. Ald. Minutes note: 03 VIETH, JR, Steven J., Class “B” Tavern application and request for a permanent extension of premises to include a patio for “The New Smokey’s” at 2425 N. Dousman Street. Special Letter Applicant at the table, 2244 N. Booth St. Neighborhood objectors present: Ralph Matula, 2424 N. Dousman St., is concerned about noise outside of the bar on the extended premises. Ald. Kovac moves to make photos submitted by Mr. Matula part of the record. Prevailed 4-0. (ALd. Zielinski excused) Lorraine Jacobs, 2412 N. Dousman St., says that there would be four bars within a two block area if this application were granted. There has also been a homicide a half-block from this establishment and she does not feel that adding another bar will make the area any safer. Currently the establishment doesn't seem to be an open business, but rather serves as a site for parties of the owner with his friends. Another concern is that parking is already tight in this area and, in winter, there is only one lane of traffic available in the street. Daniel Vogel - 2562 N. Dousman - he was led to believe that this application was merely a patio extension, but he now knows this is an attempt to open this bar, which is between two houses. These bars do not add value to a neighborhood; they are vestiges of a long-ago past. Ellen O'Grady - 2516 N. Dousman - she also does not support a fourth bar in two blocks. John Yanasak - 2531 N. Dousman - also opposed to this establishment and severely affected by the murder of Mr. Nathan Potter in the area. This is an excellent opportunity to change this from the current four bars. Amend the application to eliminate the permanent extension and grant the application as amended, by Ald. Kovac. Prevailed 3-1. (Ald. Bohl voting "no"; Ald. Zielinski excused)
