Title
Substitute resolution directing the proper City officials to prepare and execute an intergovernmental cooperation agreement between the City of Milwaukee and the City of Wauwatosa relating to maintenance responsibilities with respect to Hartung Park.
Analysis
This resolution authorizes and directs the proper City officials to prepare and execute an
intergovernmental cooperation agreement between the City of Milwaukee and the City of Wauwatosa relating to the assignment of maintenance responsibilities at Hartung Park to the two municipalities. This agreement shall, at a minimum, assign the following responsibilities to Milwaukee and Wauwatosa:
City of Milwaukee: Maintenance of the two playgrounds and equipment within these areas, maintenance of the pond, trees, and all trails in the park, and maintenance of the prairie located within the City of Milwaukee.
City of Wauwatosa: Maintenance of all turfgrass, provision and maintenance of portable toilet facility, and maintenance of the prairie located within the City of Wauwatosa.
Shared responsibilities: Capital improvements, park signage.
Body
Whereas, For over 40 years, the Department of Public Works used the former Hartung Quarry, located south of West Keefe Avenue and east of North Menomonee River Parkway, as a site for the deposit of clean fill; and
Whereas, On July 12, 2006, the Common Council adopted File Number 060292, a resolution designating the Hartung Quarry property as the site of a future park to be known as “Hartung Park”; and
Whereas, Construction of the 18.9-acre Hartung Park was completed in 2010; and
Whereas, Because Hartung Park straddles the Milwaukee-Wauwatosa border, with over one-third of the site located in the City of Wauwatosa, it is essential that the two communities determine which municipality will be responsible for various maintenance tasks at the park; and
Whereas, On June 15, 2010, the Common Council adopted File Number 100126, a resolution directing the proper City officials to prepare and execute an intergovernmental cooperation agreement between the City of Milwaukee and the City of Wauwatosa relating to maintenance responsibilities with respect to Hartung Park; and
Whereas, On October 15, 2013, the Common Council adopted File Number 130747, a substitute resolution approving an intergovernmental agreement between the City of Milwaukee and the City of Wauwatosa relating to the provision of emergency services in Hartung Park and Center Street Park; and
Whereas, Public works officials from Milwaukee and Wauwatosa recently met to discuss
maintenance responsibilities for Hartung Park and determined that the following division of tasks is appropriate:
City of Milwaukee: Maintenance of the two playgrounds and equipment within these areas, maintenance of the pond, trees, and all trails in the park, and maintenance of the prairie located within the City of Milwaukee.
City of Wauwatosa: Maintenance of all turfgrass, provision and maintenance of portable toilet facility, and maintenance of the prairie located within the City of Wauwatosa.
Shared responsibilities: Capital improvements, park signage.

Resolved, By the Common Council of the City of Milwaukee, that the proper City officials are
authorized and directed to prepare and execute an intergovernmental Memorandum of Understanding between the City of Milwaukee and the City of Wauwatosa, in substantially the same form as attached to this file, relating to the assignment of maintenance responsibilities at Hartung Park to the two municipalities; and, be it
Further Resolved, That this agreement shall, at a minimum, assign the following responsibilities to Milwaukee and Wauwatosa:
City of Milwaukee: Maintenance of the two playgrounds and equipment within these areas, maintenance of the pond, trees, and all trails in the park, and maintenance of the prairie located within the City of Milwaukee.
City of Wauwatosa: Maintenance of all turfgrass, provision and maintenance of portable toilet facility, and maintenance of the prairie located within the City of Wauwatosa.
Shared responsibilities: Capital improvements, park signage.

Further Resolved, That this agreement shall be written such that it is for perpetuity, but may be
rescinded or amended by either party upon provision of sufficient written notice to the other party.
