Title

A substitute ordinance relating to the removal of equipment and debris from work sites by city contractors and subcontractors.

Analysis

This ordinance requires any contractor or subcontractor, doing work for the city under any contract entered into with the city or any of its departments or agencies, to remove all equipment and debris from work sites, and provides a penalty for those contractors or subcontractors which fail to do so.

 

Body

 

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1.  Section 79-11.5 of the code is created to read:

 

79-11.5. Removal of Debris and Equipment from City Work Sites.

Any contractor or subcontractor, doing work for the city under any contract entered into with the city or any of its departments or agencies, shall remove any debris or equipment located in the public right-of-way at the conclusion of the contracted project.

 

Part 2. Section 79-16-1-a of the code is amended to read:

 

79-16. Penalty 1. FORFEITURE.

 

a. Any person who violates any provision of this subchapter except ss. 79-5.5, 79-11, >>79-11.5,<< 79-12-1 and 79-14-2 shall forfeit $500 including all forfeitures, penalties, fees and assessments levied by the court for the first offense and for each subsequent offense, and the costs and disbursements of such action, and in default thereof, or failure to discharge the imposed forfeit through community service or other means satisfactory to the court, shall be imprisoned as provided by law.

 

Part 3. Section 79-16-1-d of the code is amended to read:

 

79-16. Penalty 1.

 

d. Any person who violates ss. 79-11>>, 79-11.5<< or 79-12-1 shall forfeit $500 including all forfeitures, penalties, fees and assessments levied by the court for the first offense and any offense occurring between the hours of 8:00 p.m. and 5:00 a.m. on a street designated as a cruising area under s. 101-20.5 including the land within the street lines whether or not improved, and the costs and disbursements of such action, and in default thereof, or failure to discharge the imposed forfeit through community service or other means satisfactory to the court, shall be imprisoned as provided by law.
