Title

Substitute resolution relating to the duties and membership of the Community Collaborative Commission.

Analysis

This resolution rescinds Common Council File Number 180453, adopted June 20, 2018, which established the Community Collaborative Committee to address the United States Department of Justice draft report on the Milwaukee Police Department and Fire and Police Commission, and establishes the Community Collaborative Commission to meet the requirements set forth in the Charles Collins, et al., v. City of Milwaukee, et al., settlement agreement, and to provide a forum for and solicit community input regarding law enforcement policies, procedures and practices in Milwaukee, particularly with respect to the treatment of members of minority, LGBTQ, disabled and other historically underserved and underrepresented communities. The Community Collaborative Commission will be composed of:

 

1.                     Three members to be appointed by the President of the Common Council.

2.                     A member to be appointed by the Mayor.

3.                     The President of the Milwaukee chapter of the NAACP, or his or her designee.

4.                     The Director of the African-American Round Table, or his or her designee.

5.                     One plaintiff of the Collins, et al., v. City of Milwaukee, et al., lawsuit, or plaintiff’s designee, to be appointed by the American Civil Liberties Union of Wisconsin.

6.                     The Executive Director of the Southside Organizing Center, or his or her designee.

7.                     The Executive Director of Voces de la Frontera, or his or her designee.

8.                     The Executive Director of the Milwaukee LGBT Community Center, or his or her designee.

9.                     The President of IndependenceFirst, or his or her designee.

10.                     The President of Pathfinders, or his or her designee.

11.                     The Director of The Asha Project, or his or her designee.

12.                     The Executive Director of the Milwaukee Islamic Dawah Center, or his or her designee.

13.                     The Executive Director of the Hmong American Women’s Association, or his or her designee.

14.                     A member with academic expertise in police-community relations or community engagement, to be appointed by the President of the Common Council. This member shall not have been an employee or contractor of the City for two years prior to appointment.

 

Body

Whereas, Common Council File Number 180453, adopted on June 20, 2018, established the Community Collaborative Committee to:

 

1.                     Gather and review in-person and on-line community feedback, suggestions and comments in relation to the recommendations and other issues addressed in the United States Department of Justice draft report on the Milwaukee Police Department and Fire and Police Commission.

 

2.                     Based on this community feedback, determine which recommendations should be prioritized and develop solutions to the issues addressed in the draft report.

 

3.                     Prepare a report summarizing the community feedback and the Committee’s suggestions for priorities and solutions, and present the report to the Fire and Police Commission and the Common Council.

 

; and

 

Whereas, On July 20, 2018, the City of Milwaukee executed a settlement agreement in the Charles Collins, et al., v. City of Milwaukee, et al., lawsuit concerning the policies, practices and customs related to stop-and-frisks by the Milwaukee Police Department; and

 

Whereas, As a condition of the settlement agreement, the City agreed to maintain the existing Community Collaborative Committee to seek community input on Police Department operations to improve trust between law enforcement and city residents; and

 

Whereas, The Community Collaborative Committee presented a report summarizing its research in relation to the U.S. Department of Justice report and the Committee’s suggestions for priorities and solutions to the Fire and Police Commission and the Common Council on September 12, 2019, thereby satisfying the goals set forth for the Committee by File Number 180453; and

 

Whereas, While the Collins settlement agreement is set to expire within 5 years, there will remain a need for a communication and advocacy link between historically underserved and underrepresented communities and Milwaukee law enforcement; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that Common Council File Number 180453, adopted on June 20, 2018, is rescinded; and, be it

 

Further Resolved, That the Community Collaborative Commission is established to:

 

1.                     Seek community input on Police Department operations to improve trust between law enforcement and city residents as set forth in the Charles Collins, et al., v. City of Milwaukee, et al., settlement agreement.

 

2.                     Provide a forum for and solicit community input regarding law enforcement policies, procedures and practices in Milwaukee, particularly with respect to the treatment of members of minority, LGBTQ, disabled and other historically underserved and underrepresented communities.

 

3.                     Conduct an annual survey of Milwaukee residents belonging to communities that are statistically more likely to interact with members of the Police Department, about the residents’ views on police-community relations.

 

4.                     Identify and evaluate the effectiveness of progressive policing strategies deployed in other cities, soliciting research and expert assistance as needed, in relation to reducing disparities and improving police-community relations.

 

5.                     Communicate community concerns regarding law enforcement policies, procedures and practices in Milwaukee to the Police Department and the Fire and Police Commission, and present an update to the Common Council on a quarterly basis.

 

6.                     Report annually to Common Council the Commission’s findings and recommendations for policies, practices and procedures to build trust between Milwaukee law enforcement and city residents.

 

; and, be it

 

Further Resolved, That the membership of the Community Collaborative Commission shall be as follows:

 

1.                     Three members to be appointed by the President of the Common Council.

2.                     A member to be appointed by the Mayor.

Further Resolved, That members shall serve at the pleasure of the appointing authority; and, be it

 

Further Resolved, That appointment of members shall not be subject to the approval of the Common Council; and, be it

 

Further Resolved, That the City Clerk’s Office shall provide staff support for the Community Collaborative Commission; and, be it

 

Further Resolved, That a commission chair shall be elected by the members of the Community Collaborative Commission; and, be it

 

Further Resolved, That the Chair shall select from the members of the Community Collaborative Commission two co-chairs to form an Executive Committee.
