Title

Resolution to facilitate expansion of Milwaukee Public Schools' Franklin Square Playfield by authorizing conveyance of four City-owned vacant lots to the City of Milwaukee In Trust for the Board of School Directors, in the 15th Aldermanic District.

Analysis

Adoption of this resolution by at least two-thirds vote of the Common Council of the City of Milwaukee will authorize the conveyance of four City-owned vacant lots according to the conditions in the Land Disposition Report.

Body

Whereas, The Board of School Directors for the Milwaukee Public Schools ("MPS") met on June 27, 2019 and approved expansion of the Franklin Square Playfield by acquiring the following City of Milwaukee owned vacant lots:

1305 West Center Street (Tax Key No. 324-9859-000)

1309 West Center Street (Tax Key No. 324-9860-000)

1315 West Center Street (Tax Key No. 324-9861-000)

1319 West Center Street (Tax Key No. 324-9862-000)

; and

Whereas, The City Plan Commission reviewed the proposed expansion on October 21, 2019 and has determined that use of these City-owned lots by MPS for expansion of Franklin Square Playfield is appropriate; and

Whereas, These lots will be sold in “as is” condition, without representations or warranties, including, but not limited to, soil quality and subsurface condition; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the subject transfer of vacant lots is approved; and, be it

Further Resolved, That should additional properties adjacent to Franklin Square Playfield come into City ownership they may be transferred to MPS for future expansion and improvement of Franklin Playground; and, be it

Further Resolved, That the Commissioner of the Department of City Development, or designee, is authorized to execute the offer, option to purchase, development agreement, deed, release of any deed restrictions that inhibit development and execute other legal documents, on behalf of the City, and to close the transaction according to the terms of the Land Disposition Report.
