Title

Resolution authorizing the Commissioner of Public Works to execute a Maintenance Covenant document between the City of Milwaukee and Milwaukee Metropolitan Sewerage District requiring the City of Milwaukee to keep, preserve, and maintain nine (9) green alleys constructed as part of the City’s 2017 alley reconstruction program at various locations in the 5th, 7th, 8th, 10th and 11th Aldermanic Districts.

 

Analysis

This resolution authorizes the Commissioner of Public Works to execute a Maintenance Covenant document titled Green Infrastructure Ten-Year Maintenance Covenant for Nine Green Alleys at various locations throughout the City. The Maintenance Covenant requires the City of Milwaukee to keep, preserve, and maintain the seven (7) green alleys constructed as part of the City’s 2017 alley reconstruction program at various locations in the 5th, 7th, 8th, 10th and 11th Aldermanic Districts.

 

Body

Whereas, Stormwater pollution control is an important component of the City of Milwaukee’s (City) storm water management regulations and the City’s stormwater permit with the Wisconsin Department of Natural Resources (DNR); and

 

Whereas, Nonpoint sources such as roadways have been recognized as the primary source of environmental pollution by discharging polluted runoff directly into the local streams and water bodies, threatening natural habitat and species; and

 

Whereas, In 2017, the City was awarded Green Solutions Funding from Milwaukee Metropolitan Sewerage District (MMSD); and

 

Whereas, The funds allowed the construction of permeable alleys (green alleys) bounded by the following areas:

                     

                     West Cleveland Ave., West Montana St., South 49th St. and South 50th St. - 11th Ald. Dist.

                     West Greenfield Ave., South Layton Blvd., West Scott St. and South 28th St. - 8th Ald Dist.

                     West Main St., South 61st St., South 62nd St. and lands north - 10th Ald. Dist.

                     West Auer Ave., West Concordia Ave., North 87th St. and North 88th St. - 5th Ald. Dist.

                     West Keefe Ave., West Medford Ave., West Roosevelt Dr., West Scranton Pl. and North 45th St. - 7th Ald. Dist.

                     West Chambers St., West Locust St., North 76th St. and North 77th St. - 5th Ald. Dist.

                     West Auer Ave., West Burleigh St., North 54th St. and North 55th St. (north/south leg) - 10th Ald. Dist.

                     West Keefe Ave., West Nash St., North 99th St. and North 100th St. - 5th Ald. Dist.

                     West Fiebrantz Ave., West Hope Ave., North 82nd St., and North 83rd St. - 5th Ald Dist.; and

 

Whereas, The agreement for said funding stipulated that, in order for the MMSD to reimburse the City of the cost of the project, the City shall execute a maintenance covenant in favor of MMSD; and

 

Whereas, MMSD has drafted said covenant which shall be in effect for a period of ten years; now therefore, be it;

 

Resolved, That the Commissioner of Public Works is authorized to execute Green Infrastructure Ten-Year Maintenance Covenant in favor of Milwaukee Metropolitan Sewerage District for the maintenance of green infrastructure at nine alleys located within the 5th, 7th, 8th, 10th and 11th Aldermanic Districts, said Covenant being attached to this Common Council Resolution File Number 191011 and incorporated in this resolution by reference as though set forth in full.
