Analysis

This ordinance increases fees for selected licenses and permits, effective January 1, 2020.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1.                     Section 81-15-4 of the code is amended to read:

 

81-15.  Building Mover Permits

4.  PROCESSING FEE. There shall be a processing fee of [[$6]] >>$10<< for each permit issued. (See s. 116-19.)

 

Part 2.                     Section 81-38-3 of the code is amended to read:

 

81-38.                     Concrete Contractor.

3.  There shall be a processing fee of [[$6]] >>$10<< for each license issued.  (See s. 115-26.)

 

Part 3.                     Section 81-45-3 of the code is amended to read:

 

81-45.                     Driveway Permit.

3.  There shall be a processing fee of [[$6]] >>$10<< for each permit issued.  (See s. 115-23.)

 

Part 4.                     Section 81-50-1 and 7 of the code is amended to read:

 

81-50.  Excavation Permit and Inspection Fees for Work in the Public Right of Way.

1.  GENERAL. For the excavation required for the construction or repair of an individual storm building sewer, sanitary building sewer, combined building sewer, water service, or any combination thereof laid simultaneously in a single excavation or in more than one excavation connected by tunneling or boring, the fee shall be [[$112]] >>$125<<.

7.  PROCESSING FEE.  There shall be a processing fee of [[$6]] >>$10<< for each permit issued.  (See s. 115-7.)

 

Part 5.                     Section 81-51.5 of the code is amended to read:

 

81-51.5.  Extra Garbage Cart Charge.  The extra garbage cart charge shall be [[$17]] >>$17.51<< per quarter for each extra garbage cart provided under s. 79-4-1.3.

Part 8.                     Section 81-102.1-1 to 8-b of the code is amended to read:

 

81-102.1. Public Ways: Special Permits.

1.  CURB AND GUTTER. The fee for restoration of curb and gutter with respect to the removal of a driveway shall be [[$133]] >>$167<<.

 

2.  DRIVEWAYS-TEMPORARY. The fee for installation of a temporary driveway (driveover curb) shall be [[$114]] >>$143<<.

 

3.  FENCES. The fee for installation of a fence encroaching on the public right of way shall be [[$114]] >>$143<<.

 

4.  HOLLOW WALKS. The fee for performance of any work on a sidewalk situated over a hollow walk shall be [[$119]] >>$149<<.

 

5.  POLES. The fee for installing, replacing and removing utility poles shall be computed at [[$119]] >>$149<< per block face. A block face shall consist of both sides of the street and not exceed 100 house numbers. In instances when a block face of 100 house numbers is divided by one or more intersecting public ways, each subdivision shall constitute a block face.

 

6.  SIDEWALKS.

a.  The fee for replacing sidewalks shall be computed at [[$111]] >>$139<< for regular walks per block face and [[$195]] >>$244<< for full walks per block face. A block face shall consist of both sides of the street and not exceed 100 house numbers. If a block face of 100 house numbers is divided by one or more intersecting public ways, each subdivision shall constitute a block face.

b. The fee for replacing a sidewalk adjacent to a single parcel, up to 150 feet in frontage, shall be [[$25]] >>$32<<.

 

7.  STREET CUTS. The fee for replacing and filling street cuts shall be [[$195]] >>$244<<.

 

8.  INSPECTION COSTS.  a.  An additional fee shall be charged for each permit under subs. 1 to 4, 6-a and 7 to cover costs of inspection in the amount of [[$107]] >>$134<<.

b.  An additional fee shall be charged for each permit under sub. 6-b to cover costs of inspection in the amount of [[$25]] >>$32<<.

 

Part 9.                     Section 81-102.3 of the code is amended to read:

 

81-102.3.  Purchasing Appeals. The fee required for a vendor to appeal bid specifications and recommendations for awards pursuant to s. 16-05 of the charter and s. 310-19 of the code shall be [[1%]] >>1.25%<< of the amount of the bid being appealed.

 

Part 10.                     Section 81-102.4 of the code is amended to read:

 

81-102.4.  Purchasing-Restoration to Bidders Lists. The fee required for a vendor to be restored to bidders lists maintained by the purchasing division - department of administration, subsequent to the division’s removal of a vendor's name if the vendor does not respond on 3 consecutive bids, shall be [[$80]] >>$100<<.

 

Part 11.                     Section 81-102.6-2 and 3 of the code is amended to read:

 

81-102.6.  Recycling, Salvaging or Towing Premises License.

2.  The fee for each license shall be [[$275]] >>$344<<.

3.  The fee for each additional building or other fixed place for storage, as provided in s. 93-5-3, shall be [[$50]] >>$63<<. (See ch. 93.)

 

Part 12.                     Section 81-102.8-2 to 4 of the code is amended to read:

 

81-102.8.  Recycling, Salvaging or Towing Vehicle License.

2.  The fee for each license shall be [[$150]] >>$188<<.

3.  For a business with 2 or more vehicles, as provided in s. 93-5-2-a-2, the fee shall be [[$275]] >>$344<<.

4.  The fee to change the motor vehicle used in the conduct of a recycling, salvaging or towing business shall be [[$10]] >>$15<<.  (See ch. 93.)

 

Part 13.                     Section 81-104.7-2 of the code is amended to read:

 

81-104.7.                     Sewer Connection.

Part 14.                     Section 81-115-1 and 2 of the code is amended to read:

 

81-115.  Special Privileges; Granting of Encroachments.

a.  Commercial Buildings and Residential Buildings Containing 3 or More Units, New Construction and Additions.

a-1-a.  Residential buildings containing 3 or more units: [[$0.36]] >>$0.38<< per square foot.

a-1-b.  Industrial and manufacturing buildings: [[$0.30]] >>$0.32<< per square foot.

a-1-c.  All other commercial buildings: [[$0.34]] >>$0.36<< per square foot.

b.  Dwellings, New Construction and Additions.

b-1.  The fee for all one-and 2-family dwellings shall be computed at [[$0.36]] >>$0.38<<  per square foot, using the definition set forth in s.200-08-86.2.

c.  Structures Accessory to One  and 2 family Dwellings.  c 1. The fee for garages and other structures of more than 150 square feet in area accessory to one  and 2 family dwellings shall be computed at [[$0.25]] >>$0.26<<  per square foot of area.  The minimum fee shall be [[$65]] >>$68<<.

c 2.  The fee for sheds and other structures accessory to one  and 2 family dwellings and not more than 150 square feet in area shall be [[$65]] >>$68<<.

d 1.  The fee for footing and foundation permits shall be computed at [[$0.10]] >>$0.11<< per square foot of floor area of the first floor of the building or structure.

e.  Odd Structures.  The fee for permanent odd structures, such as parking lots, reviewing stands and tank towers or additions thereto shall be computed at [[1.3%]] >>1.4%<< of the cost of construction.  The minimum fee shall be [[$65]] >>$68<<.

g.  Solar PV.

g-2.  The building permit fees for installations of all other solar PVs shall be as follows:

g-2-c.  35.1-50 kilowatts: [[$150]] >>$158<<.

Part 27.                     Section 200-33-17 of the code is amended to read:

 

17.  FIRE INSPECTIONS. An annual fee shall be charged, equal to 1.5% of the city portion of the combined gross property tax levy, which is levied upon the inspection property. The minimum fee shall be [[$65]] >>$100<< and the maximum fee shall be [[$390]] >>$525<<. Fire inspection fees shall be charged against the real estate upon which the inspection takes place, shall be a lien upon the real estate and shall be assessed and collected as a special charge.

Part 43.                     Section 200-33-48-a of the code is amended to read:

 

48.  REINSPECTION FEE.

a.  To compensate for inspectional and administrative costs, a fee of [[$100]] >>$175<< may be charged for any reinspection to determine compliance with an order to correct conditions of provisions of the code under the jurisdiction of the department of neighborhood services or assigned to the department, except no fee shall be charged for the reinspection when compliance is recorded. A fee of [[$200]] >>$350<< may be charged for each subsequent reinspection. Reinspection fees shall be charged against the real estate upon which the reinspections were made, shall upon delinquency be a lien upon the real estate and shall be assessed and collected as a special charge for payment and settlement as provided in ch. 19 of the city charter.

Part 52.                     Section 200-33-61.5 of the code is amended to read:

 

61.5.  TITLE SEARCH. The fee for a written report on pending special charges and information on pending work orders in the department shall be [[$40]] >>$50<< per address.

 

Part 53.                     Section 200-33-62-c of the code is amended to read:

 

62.  UNDERGROUND FIRE PROTECTION PIPING FOR FOAM LINES.

c.  There shall be a processing fee of [[$8]] >>$10<< for each permit issued.

 

Part 54.                     Section 200-33-65-b of the code is amended to read:

 

65.  VARIANCES, STATE BUILDINGS CODE.

b.  There shall be a processing fee of [[$8]] >>$10<< for each petition issued.

 

Part 55.                     Section 200-33-66-b of the code is amended to read:

 

66.  WOOD AND STOVE OR PREFABRICATED FIREPLACES.

Part 56.    This ordinance takes effect January 1, 2020.
