This resolution appropriates $5,662.59 from the Remission of Taxes Fund special purpose account to pay the settlement of a claim against the City regarding the 2006 assessment of Brewery Project LLC.
Body
Whereas, Brewery Project LLC had filed a Wis. Stat. § 74.37 claim for a 2006 property tax refund; and
Whereas, On August 28, 2007, the Board of Review ordered a reduction in that assessment; and
Whereas, The Assessor and the claimant had reached an agreement whereby payment of that refund would not occur until January 31, 2009; and
Whereas, The claimant is entitled by law to interest on that amount for one year at the annual rate of 5% pursuant to Wis. Stat. § 138.04; and
Whereas, The unique fact circumstances of this case set no legal precedent whatsoever; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that $5,662.59 is appropriated from the 2009 Remission of Taxes Fund special purpose account (0001-9990-S163-006300) to pay by check the settlement of this claim against the City; and, be it
Further Resolved, That the City Comptroller is authorized and directed to make whatever fund transfers and payments necessary or appropriate to carry out the provision of this resolution.
