Analysis
This Resolution approves a land disposition report and authorizes the City of Milwaukee to convey 6731 R. N. 91st Street to the Riverwoods of Milwaukee Homeowners Association Limited in accordance with that report.
Body
Whereas, The property at 6731 R. N. 91st Street (the Site) is common area for the Riverwoods of Milwaukee Subdivision, and it also is the location of the storm water management detention pond for that Subdivision’s Milwaukee Code of Ordinances (MCO) Ch. 120 storm water management plan; and

Whereas, When the original subdivision developer conveyed the Site to the Subdivision’s Homeowners Association (the HOA) (the Riverwoods of Milwaukee Homeowners Association) by deed recorded on February 18, 2003, the developer directed, in that deed, that tax bills continue to be sent to the developer’s address which should not have happened, because as a result, the new owner, the HOA, did not get property tax bills for the Site or notice from the City about the City tax foreclosure against the Site; and

Whereas, The City acquired the Site by property tax foreclosure in the City’s 2007 No. 1 tax foreclosure filing and the City owns the Site; and

Whereas, Despite City ownership, the HOA has maintained the Site over the years including the storm water management pond at the Site, and the HOA desires to be the owner of the Site; and

Whereas, A Land Disposition Report (LDR) concerning the Site has been submitted to this file that explains more background about the Site, and the LDR also contemplates a conveyance of the Site by the City to the HOA for $1; and

Whereas, The HOA meets the buyer restrictions of MCO 304-49-9 including MCO 304-49-9-e; now therefore, be it
