Analysis

This resolution directs the Department of Administration - Intergovernmental Relations Division to seek introduction and passage of State legislation to amend the State statute which prohibits certain applicants with criminal histories from receiving industrial hemp licenses so that State law reflects the less restrictive 10-year ban promulgated by Federal law.

Body

Whereas, Industrial hemp production is a quickly emerging market; and

 

Whereas, Wisconsin has been exceeding expectations in hemp production and is expected to be one of the top producers of hemp within the next 10 years; and

 

Whereas, A feasibility study is underway to determine if the Century City development site is capable of supporting industrial hemp production (Common Council File Number 181465); and

 

Whereas, The Century City development site is near the most incarcerated ZIP code, 53206, in the country for African American men; and

 

Whereas, The production of industrial hemp would be a significant source of jobs and economic growth for this community; and

 

Whereas, There is a national effort to expunge the records for those with marijuana convictions; and

 

Whereas, Those who have demonstrated rehabilitation should be permitted to participate in this rapidly growing market; and

 

Whereas, The Agriculture Improvement Act of 2018 only requires that a person convicted of a felony relating to a controlled substance under State or Federal law be ineligible for an industrial hemp license for a 10-year period; and

 

Whereas, The provisions of s. 94.55(3), Wis. Stats., are unnecessarily restrictive in disallowing any individual with a past drug conviction from participating in this market; now, therefore be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Department of Administration - Intergovernmental Relations Division is directed to seek introduction and passage of State legislation to amend the State statute which prohibits certain applicants with criminal histories from receiving industrial hemp licenses so that State law reflects the less restrictive 10-year ban promulgated by Federal law.

 

Further Resolved, That File Number 180898 is amended by inserting the following item in the document attached to the file and identified as “AMENDED 2019-2020 State Legislative Detailed Proposals and Key Issues”:

 

Promote Racial, Social and Economic Equity for City Residents
