Resolution approving the execution of a Reciprocal Access and Parking Agreement relative to Westlawn Gardens and authorizing the Secretary-Executive Director to execute the Reciprocal Access and Parking Agreement on behalf of Westlawn Renaissance, LLC, WG Scattered Sites, LLC and Victory Manor, LLC

WHEREAS, Westlawn Gardens is generally situated to the south of West Silver Spring Drive between North 60th Street and North 68th Street and the Housing Authority of the City of Milwaukee (HACM) is currently proceeding with redevelopment of Westlawn Gardens in cooperation with Westlawn Renaissance LLC (“WR”), WG Scattered Sites LLC (“SS”) and Victory Manor LLC (“VM”); and
WHEREAS, a Reciprocal Access and Parking Agreement (“Parking Agreement”) by and among HACM, WR, SS and VM providing for the allocation of shared Private Parking Spaces (as defined therein) to the owners of various Parcels (as defined therein) is on file with HACM; and
WHEREAS, the Parking Agreement is necessary in order to demonstrate compliance with the applicable zoning requirements of the City of Milwaukee as well as to provide for the ongoing operation, maintenance and repair of the Shared Private Parking Spaces; and
WHEREAS, WR and SS previously entered into a Reciprocal Access and Parking Agreement (WG Scattered Sites) dated as of March 30, 2017 and recorded in the office of the Milwaukee County Register of Deeds on April 3, 2017 as Document No. 10661584 (the “Prior Parking Agreement”) which is superseded by the Parking Agreement; and
WHEREAS, pursuant to this Resolution the Commissioners of HACM desire to approve and authorize execution of the Parking Agreement and a termination of the Prior Parking Agreement by the Secretary - Executive Director on behalf of HACM, WR, SS and VM.
NOW, THEREFORE, BE IT RESOLVED, by the Housing Authority of the City of Milwaukee that the Parking Agreement and the termination of the Prior Parking Agreement are hereby approved and the proper officers are hereby authorized and directed to execute and deliver the Parking Agreement in substantially the form on file with HACM or in such form and substance as may be approved by the Secretary-Executive Director; and be it
FURTHER RESOLVED, that the Secretary-Executive Director is hereby authorized and directed to execute and deliver the Parking Agreement and the termination of the Prior Parking Agreement on behalf of WR, SS and VM in substantially the form on file with HACM or in such form and substance as may be approved by the Secretary-Executive Director.
