Resolution authorizing the Commissioner of Public Works to execute Change Order One to the Green Solutions funding agreement with the Milwaukee Metropolitan Sewerage District for the installation of bioswales within the medians of West Bradley Road between North 51st Street and North 124th Street in the 5th and 9th Aldermanic Districts.
Analysis
This resolution authorizes the Commissioner of Public Works to execute Change Order One to the Milwaukee Metropolitan Sewerage District Green Solutions funding agreement for the installation of bioswales within the medians of West Bradley Road between North 51st Street and North 124th Street in the 5th and 9th Aldermanic Districts. The change order allows the City of Milwaukee to construct the bioswales without any City share.

Whereas, Common Council File No 180394 authorized the City to enter into an agreement (Green Solution Funding Agreement G98005P07) with the Milwaukee Metropolitan Sewerage District (MMSD) to accept and fund a Green Solutions grant for the installation of bioswales on West Bradley Road between North 51st Street and North 124th Street; and
Whereas, Said File also authorized expenditures of $500,019 in grantor share and $179,981 in City share; and
Whereas, The total estimated construction cost of said bioswales on West Bradley Road is revised to $580,000 and can be funded in its entirety by grantor share; and
Whereas, MMSD has prepared Change Order One amending Section 4 of said agreement to indicate that it will provide up to a maximum of $580,000 in grantor funds; and
Whereas, Said change order will provide additional $79,981 in grantor funds; and
Whereas, Common Council File Number 180295 authorized the expenditure of $680,000 in construction costs for the bioswales in West Bradley Road (SM499170102); and
Whereas, The unused portion of said capital funds shall be returned to the parent account; now, therefore, be it
Resolved, That the Commissioner of Public Works is authorized to accept and execute Change Order One to the MMSD Green Solutions grant agreement without further Common Council approval, unless the terms of the grant change as indicated in Common Council File 030712; and, be it
Further Resolved, That upon approval of the change order to said Agreement, the City Comptroller is authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for this project, and transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:

; and, be it
Further Resolved, That these funds are appropriated to the Department of Public Works, which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant budgets and incur costs consistent with the award date; and, be it
Further Resolved, That the Commissioner of Public Works shall have the authority to authorize transfers within the project budget so long as the amount expended for any purpose shall not exceed the amount authorized by the budget by 10% and such transfers are in accordance with grantor regulations; and, be it
Further Resolved, That the Commissioner of Public Works, on behalf of the City of Milwaukee, is authorized to enter into subcontracts (and leases) as detailed in the project budget and in accordance with City purchasing procedures and grant and aid guidelines for awarding such contracts.
Resolved, That the Commissioner of Public Works is authorized to execute the change order to the Green Solutions funding agreement between the City and the MMSD, said change order being attached to this Common Council Resolution File Number ----___________ and incorporated in this resolution by reference as though set forth in full.
