Analysis

This ordinance revises tow operator recordkeeping to require a tow truck operator to submit a form to the city signed by an owner or authorized operator of a motor vehicle who is present before the vehicle is fully hooked up for tow indicating the owner or authorized operator paid, or declined to pay, the drop fee after being advised payment of the drop fee would avert the tow.

 

If an owner or authorized operator of a motor vehicle refuses to sign the form, the tow truck operator will indicate the refusal on the form, and sign and submit the form.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part. 1: Section 93-47-3-e of the code is repealed and recreated to read:

 

93-47. Motor Vehicle Towing.

 

3. DROP FEE.

e. A tow truck operator shall submit to the city a form, or forms, approved by the commissioner of public works, signed by an owner or authorized operator of a motor vehicle who is present before the vehicle is fully hooked up for tow indicating the owner or authorized operator paid, or declined to pay, the drop fee after being advised payment of the drop fee would avert the tow.

 

Part. 2: Section 93-47-3-f of the code is created to read:

 

3. DROP FEE.

f. If an owner or authorized operator of a motor vehicle who declines to pay a drop fee refuses to sign the form specified in par. e, the tow truck operator shall indicate the refusal on the form, and sign and submit the form as provided in par. e.
