Title
Resolution directing the Commissioner of Public Works to execute project agreements titled State/Municipal Agreement for a State Let Urbanized Area STP-Urban Project with the Wisconsin Department of Transportation and to set up funds for design engineering at total estimated cost of $2,650,060 and an estimated City of Milwaukee share of $530,013 and a grantor share of $2,120,047.
Analysis
This resolution authorizes and directs the Commissioner of Public Works to execute project agreements with the Wisconsin Department of Transportation for the programming, design and construction of local arterial Streets with 80 percent Federal and State aid under the Surface Transportation Program. This resolution also directs the City of Milwaukee Comptroller to transfer funds and establish project grant chartfield values for the preliminary engineering for these projects. The estimated total cost of the projects is $10,678,028 of which the City’s share is $2,427,533 and the grantor share is $8,250,495. The estimated preliminary engineering cost for these projects is $2,650,060 which the City’s share is $530,013 and the grantor’s share is $2,120,047. Construction funds for these projects will be included in future resolutions.

Whereas, The project agreements have been requested and received from the Wisconsin Department of Transportation to be executed by the City of Milwaukee for the programming, design and construction of the following paving projects with Federal and State aid under the Surface Transportation Program:

Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee of project cost overruns and changes in scope approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100 percent liable for project cost overruns and changes in scope as approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; and
Whereas, Construction on these projects is currently scheduled to start in 2022-2023; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby directed to execute agreements for the programming, design and construction of the aforementioned projects with Federal and State aid under the Surface Transportation Program, copies of which are attached and are incorporated in this resolution by reference as though set forth in full; and, be it
Further Resolved, That the Commissioner of Public Works is hereby directed to undertake, or engage a consultant to undertake, design engineering for the improvement of the aforementioned projects and to reimburse the Wisconsin Department of Transportation for design engineering costs they incur for the improvement; and, be it
Further Resolved, that the Commissioner of Public Works is hereby authorized and directed to sign documents that are required if right-of-way acquisition is necessary as part of the project work; and, be it
Further Resolved, That the Commissioner of Public Works is hereby authorized and directed to enter into an agreement with the Wisconsin Department of Transportation pertaining to the cost participation for the installation and modification of traffic control facilities in conjunction with the improvements of the aforementioned projects; and, be it
Further Resolved, That the Commissioner of Public Works is hereby authorized and directed to negotiate and enter into cost sharing agreements with adjacent municipalities for those projects whose project limits extend beyond the City of Milwaukee boundaries; and, be it
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project Grant Chartfield Values for design engineering for the projects (Expenditure) and transfer to any of these accounts the amount required under the grant agreement and City Accounting Policy but not to exceed a 10 percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:
