Analysis
This resolution grants a special privilege to Priya Corporation for a monitoring well in the public right-of-way for the premises at 1233 West Layton Avenue.
Body
Whereas, Priya Corporation, the applicant, is working to remove contamination from its property that was caused by a leaking underground storage tank; and

Whereas, As part of the remediation, the applicant, is being asked to install a monitoring well in the public right-of-way by the Wisconsin Department of Natural Resources; and

Whereas, Said monitoring well may only legally encroach into the public right-of-way by granting of a special privilege resolution adopted by the Common Council; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that Priya Corporation, 7222 North Teutonia Avenue, Milwaukee, WI 53209 is hereby granted the following special privilege:

To construct and maintain an 8-inch diameter monitoring well in the median of West Layton Avenue. Said monitoring well is centered approximately 45 feet north of the northline of West Layton Avenue and 158 feet east of the eastline of South 13th Street. Said monitoring well is flush with the surrounding grass.

Said monitoring well shall be used, kept and maintained to the satisfaction of the Commissioners of Public Works and Department of Neighborhood Services.

Said monitoring well shall be maintained or removed from the public right-of-way, at such future time as they are no longer needed, to the satisfaction of the Commissioners of Public Works and Department of Neighborhood Services.
