This resolution authorizes settlement of a lawsuit against Lakeside Oil, a Division of World Fuel Services, Inc. in connection with environmental remediation at Fire Station No. 35 located at 100 N. 64th Street.
Body
Whereas, The City has filed a lawsuit against Lakeside Oil, a Division of World Fuel Services, Inc., and World Fuel Services, Inc. seeking damages in the amount of $138,410.86, and
Whereas, The claim relates to allegations that Lakeside Oil, a diesel fuel delivery service previously under contract with the City of Milwaukee, negligently spilled approximately 300 gallons of fuel into the ground surrounding the Fire Station No. 35’s diesel fuel tank in 2016; and
Whereas, The City has incurred damages in the amount of $138,410.86, inclusive of staff time, to remediate the fuel spill; and
Whereas, World Fuel Services, Inc. has agreed to pay $130,000 in settlement of the lawsuit; and
Whereas, The amount offered is a fair and reasonable settlement of the City’s claim; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that City Attorney be and hereby is authorized and directed, on behalf of the City, to release and satisfy the City’s claims in the above-referenced lawsuit for an amount of $130,000, and to execute any necessary stipulations and releases to effectuate such settlement.
