Resolution authorizing payment of the settlement of claims raised by Maurita Holmes in the amount of $50,000.

Analysis

This resolution authorizes payment of the settlement of Holmes v City of Milwaukee U.S.D.C Case Number 16-CV-1727 in the amount of $50,000. 

Body

Whereas, The Plaintiff, Maurita Holmes (C.I. File No. 1032-2017-69), through her attorney, Janet Heins, Heins Employment Law Practice, LLC, has filed a claim against the City alleging employment discrimination and civil rights claims under federal and state law; and 

 

Whereas, The City has agreed to settle the claim in the amount of $50,000; and

 

Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to pay this claim; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that proper city officers be and hereby are authorized and directed to issue a City check totaling the amount of $35,452.63, payable to “Skyward Holdings” for the benefit of Maurita Holmes and a check for the remaining amount of $14,547.37 payable to Heins Employment Law Practice, LLC, 1001 West Glen Oaks Lane, #103;  Mequon, WI  53092, in full and final payment of any claims raised in the subject lawsuit, upon receipt of a General Release of Claims, approved as to form and execution by the City Attorney; said amount to be charged to Damages and Claims Account-636506 - Fund No. 0001 - Organization 1490 - Program 2631 - Sub Class S118; and, be it

 

Further Resolved, That for and in consideration of the above-referenced payment, Maurita Holmes will provide to the City a release as approved by the City Attorney of any and all claims arising out of the facts alleged in the Complaint and giving rise to Maurita Holmes v. City of Milwaukee, U.S.D.C. Case No. 16-CV-1727.
