Analysis
This resolution authorizes the recording of satisfactions to terminate Redevelopment Plans approved by the City of Milwaukee that imposed certain requirements on parcels, but are completed, expired or obsolete.
Body
Whereas, As part of the Redevelopment Authority of the City of Milwaukee’s (“Redevelopment Authority”) function under Wisconsin Statutes Section 66.1333(6)(a), it prepares comprehensive plans of redevelopment and urban renewal (“Redevelopment Plans”), which Redevelopment Plans and Amendments thereto, after due approval, are recorded in the Milwaukee County Register of Deeds Office per Wisconsin Statutes Section 66.1333(9)(a)l.c.; and
Whereas, Periodically, the Redevelopment Authority reviews recorded Redevelopment Plans and Amendments, some of which were created for Tax Incremental Districts (“TID’s”), to identify which Redevelopment Plans and Amendments are completed, expired or obsolete; and
Whereas, Some of the Redevelopment Plans and their Amendments are completed, expired or obsolete, but having been recorded, they show up on title searches as encumbrances against title and title companies list them as exceptions to title-insurance coverage; and
Whereas, Redevelopment Authority staff have received various calls from owners and buyers about such Redevelopment Plans and Amendments hindering title as encumbrances and asking for such encumbrance to be removed; and
Whereas, The Redevelopment Authority, having reviewed and considered this, wishes for a satisfaction or satisfactions, as the case may be, to be recorded with the Milwaukee County Register of Deeds Office to terminate, of record, the completed, expired or obsolete Redevelopment Plans and their Amendments as follows:
