Minutes note: Permit holder not appearing. Allen McFadyen, owner of the building at 3668-70 S. Howell Ave., the complainant, at the table. Mr. McFadyen says that the hair salon has parking in the rear of the building and that parking is limited on Howell Ave. Atty. Schrimpf asks that the information on pages 23 through 34 be introduced into the record. These pages would include a letter sent to the committee by the permit holder, which Ald. Bohl says would be problematic because there would be no opportunity for cross-examination of the permit holder. Atty. Schrimpf agreed, then requested that the affidavits of attempted service and the notice of service by publication be entered into the record. Ald. Kovac moves that the affidavits of attempted service and summons served by publication become part of the record. Prevailed 4-0. (Ald. Hamilton excused) Ald. Whereas, a notarized complaint requesting the revocation of the loading zone permit of Kathleen Mallak-Shallow, Agent for KR Mallak's Family Hair Design, Inc., for the location at 3674 South Howell Avenue was filed with the city clerk's office; and

 

Whereas, The Licenses Committee held an evidentiary hearing on July 13, 2009; and

 

Whereas, Based on the permit holder's non-appearance at committee and on testimony provided at the hearing by the complainant, the Committee voted to revoke the loading zone permit of Kathleen Mallak-Shallow, Agent for KR Mallak's Family Hair Design, Inc., for the location at 3674 South Howell Avenue ; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the loading zone permit of Kathleen Mallak-Shallow, Agent for KR Mallak's Family Hair Design, Inc., for the location at 3674 South Howell Avenue is revoked.
