 Title

Resolution approving an Amendment to the Lease Agreement between the City of Milwaukee and New Cingular Wireless PCS LLC for the placement of personal communications antennas and ancillary equipment at the Hawley Road Water Tower.

Analysis

This resolution amends a lease agreement with New Cingular Wireless PCS, LLC for the placement of personal communications services antennas at the Milwaukee Water Works facility located at 1235 North 57^th Street which was authorized by Common Council Resolution File Number 001017 adopted on November 28, 2000, amended by Common Council Resolution File Number 050898 on November 15, 2005, and amended by Common Council Resolution File Number 151901 on May 24, 2016.

Whereas, The Common Council adopted Resolution 001017 adopted on November 28, 2000  approving a lease agreement with Telecorp, Inc. for the placement of personal communications services antennas at the Milwaukee Water Works  facility located at 1235 North 57^thStreet; and

Whereas, The Common Council adopted Resolution 050898 on November 15, 2005 approving a First Amendment with New Cingular Wireless PCS, LLC as successor-in-interest to Telecorp, Inc.; and

Whereas, The Common Council adopted Resolution 151901 on May 24, 2016 approving a Second Amendment with New Cingular Wireless PCS, LLC; and

Whereas, The Milwaukee Water Works, working with the City Attorney's Office, has negotiated a third amendment to the lease agreement; and

Whereas, This third amendment of the lease agreement between the City and New Cingular Wireless PCS, LLC for the placement of personal communications services antennas at Milwaukee Water Works facility located at 1235 North 57^th Street, allows New Cingular Wireless PCS, LLC to upgrade its facilities and secures a long term commitment from New Cingular Wireless PCS; and

Whereas, The amendment provides a long term renal income stream to the City to such that the lease offers a fair market value to the City, protects other City interests, and is acceptable to all City participants; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Common Council approves and amends the lease agreement, identified as the "Third Amendment to Lease Agreement," between the City of Milwaukee and New Cingular Wireless LLC for the placement of personal communications services antennas at the Milwaukee Water Works facility located at 1235 North 57^th Street, a copy of which is attached to this file, and authorizes the proper City officials to enter into this lease amendment on behalf of the City of Milwaukee.
