Title

Resolution relating to the construction of a new monopole communications tower located at the Milwaukee Fire Department fire station located at 5600 West Oklahoma Avenue.

Analysis

This resolution authorizes lease amendments with the cellular communication providers related to the construction of a new monopole communications tower and ancillary equipment located at the Milwaukee Fire Department fire station located at 5600 West Oklahoma Avenue.

Body

Whereas, There is a monopole communications tower located at the Milwaukee Fire Department fire station located at 5600 West Oklahoma Avenue that serves City of Milwaukee public works and public safety communication systems; and

 

Whereas, The communications tower also serves Verizon Wireless, AT&T, T-Mobile, and U.S. Cellular via leases between the carriers and the City of Milwaukee; and

 

Whereas, Verizon Wireless approached the City of Milwaukee regarding constructing a new communications tower on the property along with new equipment shelters located near the base of the tower; and

 

Whereas, In order to effectuate the construction of the new tower and the new equipment shelters at the base of the tower, amendments to the leases with the four cellular communications carriers are required; and

 

Whereas, The Department of Administration working with the City Attorney's Office, has negotiated the required amendments to the lease agreements; and

 

Whereas, These amendments of the lease agreements between the City, Verizon Wireless, AT&T, U.S. Cellular, and T-Mobile, or their designated affiliates for the placement of personal communications services antennas at the Milwaukee Fire Department facility located at 5600 W. Oklahoma Ave., allow the carriers to install equipment on the new tower; and

 

Whereas, The lease amendments offer a fair market value to the City, protects other City interests, and is acceptable to all City participants; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Common Council approves the lease amendments, identified as (1) the "Second Amendment to Lease Agreement," between the City of Milwaukee and Verizon Wireless Personal Communications LP; (2) Fourth Amendment to Lease Agreement," between the City of Milwaukee and T-Mobile Central LLC; (3) “First Amendment to Lease Agreement” between the City of Milwaukee and United States Cellular Operating Company LLC; and (4)”Third Amendment to Lease Agreement” between the City of Milwaukee and New Cingular Wireless, PCS, LLC” for the placement of personal communications services antennas and ancillary equipment at the Milwaukee Fire Department Fire Station at 5600 West Oklahoma Ave., a copies of which is attached to this file, and authorizes the proper City officials to enter into these lease amendments on behalf of the City of Milwaukee; and, be it

 

Further Resolved, That the proper City officials, in consultation with the City Attorney's office, are authorized to make non-substantive changes to the lease amendments, without further Common Council action as necessary to achieve the intent of the City's action.
