Minutes note: Mr. Jones explained this item is also the result of the same contractor going out of business. However, on this particular item Travaux will incur additional costs of approximately $30,000 to match Insulation Technologies (Intec) second lowest bid in the original competitive solicitation. In addition to being a part of other current projects, Intec has performed well in the past for Travaux.

Title

Resolution approving award of contract (non-competitive procurement) to Insulation Technologies Inc. (Milwaukee, WI) for fiber cement siding for Victory Manor mid-rise apartment building at Westlawn Gardens Phase 2 in the amount of $272,484.00

 

Body:

WHEREAS, Travaux Inc. solicited competitive sealed bids by publicly advertised Official Notice Number 57835 during December 2017 and January 2018; and

 

WHEREAS, award was made to Armstrong General Contracting, the lowest responsive and responsive bidder, in the amount of $272,484.00; and

 

WHEREAS, Armstrong General Contracting went out of business without having executed the contract nor providing a performance and payment bond; and

 

WHEREAS, the construction schedule for Victory Manor is at a critical juncture and a replacement contractor is required immediately; and

 

WHEREAS, the second low bidder to the original solicitation, Insulation Technologies Inc., submitted a proposal to take over the work, to honor its original bid amount of $272,484.00, and to commence work immediately upon notice to proceed; and

 

WHEREAS, Insulation Technologies Inc. proposal amount of $272,484.00 is higher than the original award but still within budget for this work item; and

 

WHEREAS, approval from HUD was sought and granted to make an award to Insulation Technologies Inc. pursuant to a non-competitive proposal procurement as described in the Code of Federal Regulations; therefore, be it,

 

RESOLVED, by the Board of Directors of Travaux Inc. that they hereby authorize and approve accepting the proposal of and entering into a contract with Insulation Technologies Inc. for Fiber Cement Siding for Victory Manor Mid-Rise Apartment Building at Westlawn Gardens Phase 2 in the amount of $272,484.00; and, be it

 

FURTHER RESOLVED, that funds for these services will come from WHEDA Tax Credits/HUD Mixed Financing; and, be it

 

FURTHER RESOLVED, that the proper officers of Travaux Inc. be and hereby are authorized and directed to properly execute said contract for and on behalf of Travaux Inc.; and, be it

 

FURTHER RESOLVED, that if any extensions of the time of performance are needed   the officers of Travaux Inc. may approve such request without any further action of the Board of Directors of Travaux Inc.; and, be it

 

FURTHER RESOLVED, that all of above is contingent upon receiving the approval of the U.S. Department of Housing and Urban Development, if required; and, be it

 

FURTHER RESOLVED, that all acts previously performed relative to this matter by the Board of Directors of Travaux Inc. be and hereby are approved, ratified, and confirmed in all respects.
