City of Milwaukee, et al., Case No.: 17-CV-606; Deleon Mosby v. City of Milwaukee, et al., Case No.: 17-CV-607; Terrance Lee Martin v. City of Milwaukee, et al., Case No.: 17-CV-666; David Bernard Fletcher v. City of Milwaukee, et al., Case No.: 17-CV-694; Sedarian Williams v. City of Milwaukee, et al., Case No.: 17-CV-735; Joseph Gill v. City of Milwaukee, et al., Case No.: 17-CV-1154; and Derrick Griffin v. City of Milwaukee, et al., Case No.: 17-CV-1363, in the amount of $375,000.00.

 

Body

Whereas, the plaintiffs individually filed eight separate federal court cases in the Eastern District of Wisconsin alleging claims for unconstitutional body-cavity searches against numerous police officers and the City of Milwaukee, and the cases were then consolidated for the purposes of discovery due to the common issues of fact and law in all eight cases.

 

Whereas the plaintiffs have agreed to settle all eight cases for a total of $375,000.

 

Whereas, the City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to pay the proposed settlement amount in these lawsuits, now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the proper City officials be and are hereby authorized and directed to issue three separate City checks in the amount of: (1) $173,333.33 payable to the “Rohde Dales LLP Trust Account”; (2) $105,833.34 payable to “The Shellow Group”; and (3) $95,833.33 payable to “Rohde Dales LLP,” in full and final settlement of all monetary damages sought in this lawsuit against the defendants, including statutory fees and costs, on receipt of a Release of Claims, approved as to form and execution by the City Attorney,  said amount to be charged to the Damages and Claims Fund, Account No. 0001-1490-S118-006300.
