Analysis
This Resolution authorizes the City, on behalf of the Milwaukee Board of School Directors, the school district organized under Chapter 119 of the Wisconsin Statutes (“MPS”) to convey real property formerly used for school purposes and located at 2977 South 20th Street, (Clairmont), Milwaukee, Wisconsin.
Body
Whereas, Milwaukee Board of School Directors, the school district organized under Chapter 119 of the Wisconsin Statutes (“MPS”), The Boerke Company, Inc., Quarles & Brady, LLP and Central City Valuation Services have entered into an agreement dated January 12, 2007 providing for the marketing development and conveyance of real property declared surplus by MPS; and

Whereas, MPS has declared the Clairmont property located at 2977 South 20th Street, Milwaukee, Wisconsin (the “Property”) to be surplus and undertaken marketing efforts resulting in the proposed conveyance of the Property upon terms and conditions set forth in the Term Sheet (“Term Sheet”) associated with this Common Council file; and

Whereas, Legal title to MPS real property is held in the name of the City of Milwaukee, in trust for MPS; and

Whereas, The conveyance of surplus MPS property requires adoption of a resolution by the Common Council authorizing and approving such conveyance; and

Whereas, The Common Council desires to approve the conveyance of the Property upon the terms outlined in the Term Sheet; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the conveyance of the Property upon the terms and conditions outlined in the Term Sheet, is hereby approved and the proper City officers are hereby authorized and directed to execute the necessary instruments of conveyance.
