Title
Substitute resolution accepting a gift of a sculpture to be installed on the grounds of the City Hall Complex.
Analysis
This resolution authorizes the Commissioner of Public Works to accept a gift of a sculpture from an anonymous donor, and to have the sculpture installed on the grounds of the City Hall Complex.
Body
Whereas, Section 304-24 of the City of Milwaukee Code of Ordinances regulates the receipt, appropriation and expenditure of contributions received by the City; and

Whereas, An anonymous donor wishes to give the City a sculpture known as “Mixed Feelings” created by Tony Cragg; and

Whereas, The anonymous donor shall provide funds to Milwaukee Downtown, Inc., through the Greater Milwaukee Foundation, for the purchase and installation of the sculpture; and

Whereas, Upon receipt, the sculpture will be permanently installed in the planter located at the northeast corner of East Wells Street and North Water Street in front of City Hall; and

Whereas, Methods & Materials, Inc., in cooperation with the Department of Public Works will be responsible for installation of the sculpture at the expense of the donor; and

Whereas, The City will be responsible for the sculpture’s long-term maintenance and for any future liability that may arise in conjunction with the sculpture; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is authorized to accept a gift of the “Mixed Feelings” sculpture, created by Tony Cragg, from an anonymous donor, and to install the sculpture in the planter located at the northeast corner of East Wells Street and North Water Street in front of City Hall; and, be it

Further Resolved, That the Commissioner shall review the specific proposed location for the sculpture to ensure there are no adverse impacts upon public safety or convenience; and, be it
