This resolution requests the City Attorney to assign a staff attorney to the Board of Zoning Appeals.

Body

 

Whereas, The Board of Zoning Appeals is an independent agency authorized to hear appeals in matters related to the zoning ordinances; and

 

Whereas, Board members are appointed by the Mayor and are confirmed by the Common Council; and

 

Whereas, The Board acts in ways similar to a court, making it a quasi-judicial body; and

 

Whereas, The Office of the City Attorney is well-versed in municipal and zoning law; and

 

Whereas, The Office of the City Attorney lends its formal expertise in limiting liability for the City; and

 

Whereas, The City has been routinely sued for zoning and other matters; and

 

Whereas, Another quasi-judicial body, the Licenses Committee, has an assistant City attorney who regularly attends meetings and advises the Committee; and

 

Whereas, Assistant City Attorneys regularly attending meetings of the City’s quasi-judicial bodies lends a stabilizing force and consistency regardless of the make-up of that quasi-judicial bodies; and

 

Whereas, An Assistant City Attorney serves as an advisor to the quasi-judicial body to which the attorney is assigned; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the City Attorney is requested to assign a staff attorney to the Board of Zoning Appeals who will regularly attend the meetings of the Board of Zoning Appeals.
