Analysis
This resolution accepts Water Easement WE-958 for the construction, operation, maintenance, inspection, and repair of water mains, and authorizes the proper City of Milwaukee (“City”) officials to execute the document.
Body
Whereas, The following water easement is offered to the City:
Whereas, The City requested an easement needed for water facilities located approximately and immediately North of Wisconsin Department of Natural Resources Land at vacated South 44th Street; and
Whereas, The easement area is in lands owned by the State of Wisconsin and leased to The Southeast Wisconsin Professional Baseball Park District; and
Whereas, The land-owner is willing to grant Water Easement Agreement WE-958 to the City giving the City permission to enter the property to construct, operate, maintain, inspect, repair, enlarge, reconstruct, replace, and relocate, as City deems necessary, the 12” diameter water main and related facilities within the easement area on terms and conditions negotiated by the City’s Department of Public Works, as reflected in the easement documents that have been made part of this file; now therefore, be it;
Resolved, By the Common Council of the City of Milwaukee, That the proper City officials, including the Commissioner of Public Works, are hereby authorized: (i) to sign the Water Easement Agreement WE-958, in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution); and (ii) to cause the same to be recorded in the Milwaukee County Register of Deeds Office.
