Title
Resolution approving an amendment redefining “substantial deviation” in the HACM 2018 Agency Plan

Body
WHEREAS, The Board of Commissioners of the Housing Authority of the City of Milwaukee (HACM) approved HACM’s 2018 Agency Plan, required by HUD under Section 511 of the Quality Housing and Work Responsibility Act (QHWRA) of 1998, hereafter referred to as the Public Housing Reform Act (PHRA); and
WHEREAS, HACM may amend or modify any policy, rule, regulation, or other aspect of the 5-year and/or Annual Plan; and
WHEREAS, it was discovered that HACM erroneously used the definition of “significant amendment” for both a “substantial deviation” and a “significant amendment” within its Agency Plan and 5-Year Plan,
WHEREAS, a “substantial deviation” should be a smaller change that includes, but is not limited to, a change or changes to the 5-year goals or objectives, additions of Capital Funds, or changes in the use of replacement reserve funds under the Capital Fund program, which are substantial changes but do not rise to the level of a “significant amendment or modification,” which is a change in policy that significantly and materially alters HACM’s stated mission, goals, objectives and activities as stated in the Plan; now, therefore, be it
RESOLVED, that HACM will amend its 2018 Agency Plan to change the definition of a “substantial deviation,” as per attached; and, be it
FURTHER RESOLVED; that the Secretary-Executive Director and HACM staff are hereby authorized and directed to take whatever action is necessary to revise the policy and submit the amended 2018 Agency Plan to HUD.
