Analysis
Certain public health-related duties imposed on the commissioner of health by state law in his or her capacity as the health department’s local health officer cannot currently be carried out by another in his or her absence. This charter ordinance authorizes the commissioner to designate a special deputy qualified to lead a level III local health department who may perform all of the duties imposed on the commissioner by law.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 17-4.5 of the city charter is created to read:
17-4.5. Commissioner: to designate a special deputy. The commissioner may designate as a special deputy health commissioner a competent person within his or her office, with the qualifications to lead a level III local health department as set forth in s. 251.06, Wis. Stats., to act for and in his or her stead in specified matters. Such a designation shall be in writing and copies filed in the city clerk's office setting forth the specific acts the special deputy is authorized to perform in the name of the commissioner. Such authority may be revoked and amended in the same manner. Within the scope of his or her specified authority, the special deputy may perform any and all acts required by law of the health commissioner.
Part 2. This is a charter ordinance and shall take effect 60 days after its passage and publication, unless within such 60 days a referendum petition is filed as provided in s. 66.0101(5), Wis. Stats., in which event this ordinance shall not take effect until submitted to a referendum and approved by a majority of the electors voting thereon.
