Body
Whereas, On February 26, 2002 the city was granted an easement SE-2681, for sewer purposes; and
Whereas, The Owner requested City’s permission to construct a building within a portion of the sewer easement in lands north of East National Avenue and east of South Barclay Street; and
Whereas, The easement area is in lands owned by MWM, LLC; and
Whereas, The City is willing to grant Sewer Easement Amendment SEA-2681 to MWM, LLC giving the Owner permission to construct a building addition over the lands described in Sewer Easement Amendment SEA-2681; and
Whereas, Based on the terms contained in Sewer Easement Agreement SEA-2681, the City is willing to grant MWM, LLC permission to construct and maintain said Improvements; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the proper City officials, including the DPW Commissioner, are hereby authorized: (i) to allow the MWM, LLC to construct and maintain said Improvements within the Easement Area subject to the terms contained in Sewer Easement Amendment SEA-2681, and (ii) to sign the Sewer Easement Amendment, in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution); and (iii) to cause the same to be recorded in the Milwaukee County Register of Deeds Office.
