Title

Resolution approving the First Amendment to the Riverwalk Development Agreement for construction of a Riverwalk segment adjoining the property located at 1858 North Commerce Street, in the 6th Aldermanic District.

Analysis

This resolution approves the First Amendment to the Riverwalk Development Agreement for the Brewers Point Apartments Riverwalk Project.

Body

Whereas, The City of Milwaukee (“City”) via adoption of Common Council File No. 071408 on February 26, 2008, entered into the Riverwalk Development Agreement dated May 6, 2008 (“Agreement”), with Brewers Point Apartments (“Owner”); and

 

Whereas, Said Agreement established the standards, rules and procedures for City construction of the Riverwalk Improvements; and

 

Whereas, The City, the Redevelopment Authority of the City of Milwaukee (“RACM”) and the Owner now desire to enter into a First Amendment to the Agreement to extend the City’s completion date from December 31, 2008 to December 31, 2009; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the proper City officials are authorized to execute the First Amendment to the Riverwalk Development Agreement, a copy of which is attached to this Common Council File; and, be it

 

Further Resolved, That the City Attorney’s office, in cooperation with the Commissioner of City Development, is authorized to make such further minor modifications to said First Amendment that are consistent with the intent and purpose of this resolution and which are mutually acceptable to the City Attorney, the Commissioner of City Development and Brewers Point Apartments.
