Title
Substitute resolution approving construction of nonassessable public improvements at various locations and appropriating funds for these purposes with the City construction cost estimated to be $9,733,000 for a total estimated cost of these projects being $10,576,500.
Analysis
This resolution directs the installation and construction of certain public improvements which have been determined to be nonassessable by the Commissioner of Public Works. The City cost of the projects approved by this resolution is estimated to be $9,733,000. The total estimated cost of these projects is $10,576,500.

Whereas, The Common Council of the City of Milwaukee adopted preliminary resolutions determining it necessary and in the public interest to construct nonassessable improvements; and
Whereas, Plans, specifications and cost estimates have been prepared for the following described improvements:
3rd and 6th Aldermanic Districts
E./W. Keefe Ave. - N. Humboldt Blvd. to N. Port Washington Rd. (SM495080068) File Number 050317: Relay combined sewer. (Nonassessable Sewer Maintenance Relay Fund -- $3,814,000). The total estimated cost for this project including the requested amount is $3,864,000. This project is anticipated to be completed during the 2009 construction season.
6th Aldermanic District
N. Holton St. (Elimination of railroad crossing). - A point 100 feet m/l south of E. Townsend St. to E. Townsend St. (ST21090110) File Number 980033: Asphalt pavement resurfacing, replace all curb and gutter, replace sidewalk and driveway approaches where necessary, sodding (full walk), and grading. (Nonassessable New Paving Fund -- $50,000). The total estimated cost for this project including the requested amount is $50,000. This project is anticipated to be completed during the 2009 construction season.
N. Palmer St. - 300 feet m/l north of E. Townsend St. to E. Keefe Ave. (SM495090005) File Number 081391: Relaying combined sewer. (Nonassessable Sewer Maintenance Relay Fund -- $87,000). The total estimated cost for this project including the requested amount is $87,000. This project is anticipated to be completed during the 2009 construction season.
E. Townsend St. (Elimination of railroad crossing). - N. Holton St. to a point 120 feet m/l west of N. Holton St. (ST21090113) File Number 980033: Asphalt pavement resurfacing, replace all curb and gutter, replace sidewalk and driveway approaches where necessary, sodding (5.0-foot width of tree border area), and grading. (Nonassessable New Paving Fund -- $25,000). The total estimated cost for this project including the requested amount is $25,000. This project is anticipated to be completed during the 2009 construction season.

W. Forest Home Ave. Bridge (and Approaches) over the Kinnickinnic River
(ST320051301/BR320051301) (2120-13-70) File Number 041289: Bridge and Approach Asphalt Reconstruction. (Grantor Non-Reimbursable Paving Fund -- $255,190; Grantor Reimbursable Paving Fund -- $38,279; City Share Non-assessable Paving Fund -- $25,000; Grantor Non-Reimbursable Structure Fund--$3,005,679; Grantor Reimbursable Structure Fund--$450,852).

The total estimated cost for this project including the requested amount is $75,000. This project is anticipated to be completed during the 2009 construction season.

The total estimated cost for this project including the requested amount is $442,000. This project is anticipated to be completed during the 2009 construction season.

Large Diameter Sewer Exam Contract. (SM495090003) File Number 081391: Combined and storm sewer exams. (Nonassessable Sewer Maintenance Relay Fund -- $314,000). The total estimated cost for this project including the requested amount is $314,000. This project is anticipated to be completed during the 2009 construction season.

Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is authorized and directed to proceed with said work; and, be it
Further Resolved, That the City Engineer and the Commissioner of Public Works are hereby authorized to negotiate and enter into an agreement with the State of Wisconsin, Department of Transportation for the City to undertake construction management duties on the following project: W. Forest Home Ave. Bridge (and Approaches) over the Kinnickinnic River (ST320051301/BR320051301); and, be it
Further Resolved, That the City Engineer is authorized and directed to approve and make periodic payments to the State of Wisconsin, Department of Transportation after receipt of invoices from said State for the City’s share of the costs for said project: W. Forest Home Ave. Bridge (and Approaches) over the Kinnickinnic River (ST320051301/BR320051301); and, be it
Further Resolved, That upon the completion of Project W. Forest Home Ave. Bridge (and Approaches) over the Kinnickinnic River (ST320051301/BR320051301) and a determination of the actual costs, it is understood that if the City of Milwaukee’s share is less than the amount previously paid, the difference will be refunded to said City; and, be it
Further Resolved, That the Department of Public Works is authorized to use the funding as specified in the above description of work; and, be it
Further Resolved, That the City Comptroller is authorized and directed to transfer such funds which are available for this purpose to the appropriate capital Project/Grant accounts.
