12/5/20170 LICENSES COMMITTEE RECOMMENDED FOR APPROVAL

Minutes note: Mr. Henning stated that he does not dispute the evidence and that this could happen to any business. He stated that there was a birthday party held in the bar. He stated that there was no security present and the security would be starting the following week. Mr. Henning stated that the testimony was exaggerated in relation to the number of shooting incidents. He stated that the establishment offers a family-oriented environment and really cares about the neighborhood and its safety. Individual also present: ACA Patrick Leigl, City Attorney's Office stated that evidence will show shooting incidents that occurred in 2017. He submitted video of the most recent shooting incident. He stated that the licensee failed to take corrective measures in between shooting incidents as recommended by the police and alderpersons. Ald. Lewis stated that in September she agreed to give the licensee an opportunity to correct the issues with the acceptance of a revised Plan of Operation. She stated that the licensee didn't take the action serious and failed to follow through with the plan he submitted. She stated that she spoke with the licensee and he stated that the incident was not serious because no one was hurt. She stated that she is in support of the revocation and if the establishment is allowed to continue operating, there should be at least a 45 day suspension. She stated that she doesn't have faith that the licensee would improve issues even after a suspension. Off. Ralph McClain stated that he responded to a previous shooting incident that resulted in a fatality. Off. Martinez Moore stated that he reviewed and submitted into police evidence the video from the most recent shooting incident that was provided by Mr. Henning. Ald. Bohl asked the licensee about his revision of the Plan of Operation as requested in September. Ald. Rainey moved to enter into record as Exhibit #1 the video submitted by ACA Patrick Leigl. (Prevailed 5-0) Individuals present in support of the revocation: Glenn Dukert 5833 W Calumet Rd stated that he fears for the safety of the neighborhood and is in support of the revocation. He stated that he lives across the field from the premises, which is about 100 yards. Lance Renae 7754 N Delta Pl stated that he has safety concerns and is in support of the revocation. There was one additional individual present in support of the revocation. Individual in opposition of the revocation: Leo Brown 8425 N 107th St stated that he attends the bar regularly and is in opposition of the revocation. He stated that he lives approximately two miles from the establishment. Stephan Kamuiru 4701 W Mill Rd stated that he visits the premises for lunch regularly and is in opposition of the revocation. He stated that the premises are not a nuisance. Edward LaHay 7300 W Dean Rd stated that he lives .5 miles from the premises, a regular customer, and is in opposition of the revocation. Ald. Zielinski stated that the licensee failed to follow recommendations of the police captain in the past and doesn't realize what should be done to correct issues. He stated that he has no confidence that the licensee can turn things around for the better. Ald. Kovac asked Mr. Henning his thoughts on the testimony by the neighbors. He asked Ald. Lewis if she believes the licensee would improve issues if given a suspension. He stated that he doesn't feel that the licensee takes the prevention of these matters seriously. He stated that if there was security monitoring the door and parking lot, the latest incident could have been avoided. Ald. Zielinski moved approval of the revocation based on the facts in the sworn complaint, police testimony, neighborhood testimony, and aldermanic testimony. (Prevailed 5-0)
