Title
An ordinance relating to the authority of the municipal court to set temporary deposit amounts.

Analysis
This ordinance authorizes the municipal court to set temporary deposit amounts for non-traffic ordinance violations until the official municipal court non-traffic deposit schedule is approved by the common council. The ordinance further requires the municipal court to submit an updated deposit schedule for approval by the common council at least annually.
Body
Whereas, Section 800.037, Wis. Stats., provides that “The deposit in traffic cases shall be made as provided in s. 345.26. In boating cases, the deposit shall be made as provided in s. 23.66 and 23.67. The municipal court, with the approval of the governing body of the municipality, shall set the deposit schedule for all other cases.”; and

Whereas, The common council of the City of Milwaukee is the governing body of the municipality; and

Whereas, The municipal court sets deposit amounts for approval by the common council; and

Whereas, Deposit amounts may be needed to issue citations for municipal ordinance violations before the municipal court can seek approval from the common council; now, therefore

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 315-2 of the code is created to read:

315-2. Deposit Schedule 1. TEMPORARY DEPOSIT AMOUNTS. The municipal court may set temporary deposit amounts until the official municipal court non-traffic deposit schedule is approved by the common council.

2. DEPOSIT SCHEDULE TO BE UPDATED ANNUALLY. The municipal court shall submit an official municipal court non-traffic deposit schedule to the common council for approval at least once every calendar year.
