Title

Resolution granting the University of Wisconsin-Milwaukee permission to install and maintain underground conduit in the public right-of-way for the premises at 2419 East Kenwood Boulevard in the 3rd Aldermanic District in the City of Milwaukee.

Analysis

This resolution permits the University of Wisconsin-Milwaukee to install and maintain underground electrical conduit under two alleys subject to review and approval of the Commissioner of Public Works for the premises at 2419 East Kenwood Boulevard.

Body

Whereas, The University of Wisconsin-Milwaukee desires to install the underground electrical conduit in order to power lighting for an adjacent parking lot; and

 

Whereas, The conduits may only legally encroach in the public right-of-way by the granting of a permissary resolution by the Common Council; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the University of Wisconsin-Milwaukee is granted permission to install and maintain 4-inch diameter underground conduit as described below:

 

1.                     Under and across the 22-foot wide east-west alley in the block bounded by East Kenwood Boulevard, East Linwood Avenue, North Prospect Avenue, and North Stowell Avenue at a point approximately 148 feet east of the eastline of North Prospect Avenue.

 

2.                     Under and across the 16-foot wide north-south alley in the block bounded by East Kenwood Boulevard, East Linwood Avenue, North Prospect Avenue, and North Stowell Avenue at a point approximately 193 feet south of the southline of East Kenwood Boulevard.

 

; and, be it

 

Further Resolved, That location and method of installation of said conduit shall be subject to the approval of the Commissioner of Public Works; and, be it

 

Further Resolved, That the University of Wisconsin-Milwaukee shall obtain all necessary permits for the installation of said conduit placed in the public right-of-way; and, be it

 

Further Resolved, That University of Wisconsin-Milwaukee shall keep and maintain said conduit to the satisfaction of the Commissioner of Public Works; and, be it

 

Further Resolved, That whenever permission for said conduit is discontinued for any reason whatsoever, including public necessity whenever so ordered by resolution adopted by the Common Council, the University of Wisconsin-Milwaukee shall not only remove all conduit, but shall also restore to its former condition and to the approval of the Commissioner of Public Works the curb, pavement or other public improvement which was removed, changed or disturbed by reason of the granting permission for said conduit. Such grantee shall be entitled to no damages due to the alteration and/or removal for such purposes.
