Title

Resolution granting the University of Wisconsin-Milwaukee permission to install and maintain street lights with appurtenant facilities and an emergency phone into the public right-of-way in the 3rd Aldermanic District.

Analysis

This resolution permits the University of Wisconsin-Milwaukee to install and maintain pedestrian level street lights and an emergency phone along with necessary junction boxes and underground communications and electrical conduits in public right-of-way of North Maryland Avenue adjacent to Downer Woods subject to review and approval of the Commissioner of Public Works.

Body

Whereas, The University of Wisconsin-Milwaukee desires to install nine pedestrian level street light poles and an emergency phone along with appurtenant underground conduits and junction boxes in order to maintain a safe environment adjacent to the Downer Woods; and

 

Whereas, The light poles, emergency phone, underground conduits and junction boxes may only legally encroach in the public right-of-way by the granting of a permissary resolution by the Common Council; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the University of Wisconsin-Milwaukee is granted permission to install and maintain nine street lights, an emergency phone, underground conduit and junction boxes in the east sidewalk area of North Maryland Avenue; and, be it

 

Further Resolved, That location and method of installation of said items shall be subject to the approval of the Commissioner of Public Works; and, be it

 

Further Resolved, That the University of Wisconsin-Milwaukee shall obtain all necessary permits for the installation of any of said items placed in the public right-of-way; and, be it

 

Further Resolved, That University of Wisconsin-Milwaukee shall keep and maintain said items to the satisfaction of the Commissioner of Public Works; and, be it

 

Further Resolved, That whenever permission for said items is discontinued for any reason whatsoever, including public necessity whenever so ordered by resolution adopted by the Common Council, the University of Wisconsin-Milwaukee shall not only remove all items, but shall also restore to its former condition and to the approval of the Commissioner of Public Works the curb, pavement or other public improvement which was removed, changed or disturbed by reason of the granting permission for said items. Such grantee shall be entitled to no damages due to the alteration and/or removal for such purposes.
