This resolution authorizes proper City officials to execute Sewer Easement SE-2875 and Release of Sewer Easement SE-1820 located in the area east of North Water Street between East Mason Street and East Wells Street, in the 4th Aldermanic District.

Body
Whereas, The City of Milwaukee (“City”) was granted Sewer Easement SE-1820 by City Square Redevelopment Corporation in a document recorded on September 26, 1967 with the Milwaukee County Register of Deeds for access to and maintenance of an 18-inch combined sewer located in the area east of North Water Street between East Mason Street and East Wells Street, in the 4th Aldermanic District; and

Whereas, BMO Harris Bank, NA (“BMO”) now owns and wishes to develop the property with address 778 North Water Street, and tax key number of 392-0707-111, affected by SE-1820 and during its site analysis determined that the legal description of SE-1820 is incomplete; and

Whereas, The City and BMO agree to release SE-1820 and replace it with Sewer Easement SE-2875 that includes the corrected legal description, preserving City’s right to enter the easement area to construct, operate, maintain, inspect, and repair, as City deems necessary, sewer facilities within the easement area on terms and conditions negotiated by the City’s Department of Public Works, as reflected in the easement document that has been made part of this file; now, therefore, be it
