Resolution authorizing the City Attorney to litigate to oppose the request of Flint Hills Resources Pine Bend, LLC to have its property located in the City of Milwaukee classified as manufacturing property.
Analysis
This resolution authorizes the City Attorney to litigate to oppose Flint Hills Resources Pine Bend, LLC’s request to the Wisconsin Department of Revenue to have its property classified as manufacturing property.
Body
Whereas, Flint Hills Resources Pine Bend, LLC (“Flint Hills”) owns certain oil terminal property located in the City; and
Whereas, The City Assessor currently assesses Flint Hills’ oil terminal property; and
Whereas, Flint Hills made a request to the Wisconsin Department of Revenue (WDOR) to classify its oil terminal property as manufacturing property pursuant to Wis. Stat. § 70.995; and
Whereas, There is a potential for negative financial impact to the City of Milwaukee if the property is classified as manufacturing property; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the City Attorney is authorized to file any necessary paper work to intervene or otherwise become a party in litigation involving Flint Hills and the WDOR and to oppose the request of Flint Hills to have its oil terminal property located in the City of Milwaukee classified as manufacturing property.
