Analysis

This resolution authorizes settlement of negligence and wrongful death claims by the estate and children of Barbara Killebrew for the total amount of $200,000.

Body

Whereas, The claimants, LaShea Killebrew, Lawanda Killebrew, Shondell Killebrew and Letoyia Killebrew, together with the Estate of Barbara Killebrew, filed a notice of claim and notice of circumstances giving rise to a claim concerning allegations of negligence on the part of employees of the Milwaukee Police Department in regard to the death of Barbara Killebrew on June 24, 2014; and

 

Whereas, The claimants and the City of Milwaukee have entered into an agreement to settle the claims raised by them in the above-referenced claim for the total amount of $200,000; and

 

Whereas, The City Attorney recommends that the City of Milwaukee settle this claim; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the proper City officers be and hereby are authorized and directed to issue a City check in the sum of $200,000 to the Trust Account of Sperling Law Offices, LLC, to be charged to the Damages and Claims Fund, Account No. 0001-1490-S118-006300; and, be it

 

Further Resolved, That for and in consideration of the above-referenced payment, claimants will provide to the City releases as approved by the City Attorney of any and all claims arising out of or in any way related to the subject incident.
