This resolution authorizes settlement of all lawsuits and potential claims raised by the plaintiffs, and potential plaintiffs Six Star Holdings, LLC, Ferol, LLC, Boardroom Entertainment MKE, LLC Mookie Exotic, LLC, MKE Downtown Ventures, LLC, Simplified Investments, LLC, Jon Ferraro, Joe Modl, Scott Krahn, Craig Ploetz, Dusanka Buzdum, Boro Buzdum, Radomir Buzdum, John Urban, and Roaring 20’s Management, LLC, under the terms of the three proposed settlement agreements/release of claims documents attached to this file.

Whereas, Plaintiffs filed lawsuits against the City entitled Six Star Holdings, LLC et al. v. City of Milwaukee, United States District Court for the Eastern District of Wisconsin, Case No. 2:15-cv-175-LA, Boardroom Entertainment MKE, LLC v. City of Milwaukee, Milwaukee Circuit Court, Case No. 15-CV-8812, Boardroom Entertainment MKE, LLC v. City of Milwaukee, United States District Court for the Eastern District of Wisconsin, Case No. 2:15-cv-53, and Mookie Exotic, LLC v. City of Milwaukee, United States District Court for the Eastern District of Wisconsin, Case No. 2:16-cv-286 alleging various constitutional violations; and

 

Whereas, The Plaintiffs have agreed to settle the claims raised in the above-referenced lawsuits; and

 

Whereas, The Plaintiffs will provide to the City a release of claims; and

 

Whereas, The City Attorney recommends that the City of Milwaukee settle these lawsuits; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, the City Attorney is authorized to enter into the three proposed settlement agreements/release of claims documents attached to this file and to execute and approve all documents and take all action necessary to carry out the terms and conditions of the agreements.
