Analysis

This ordinance:

 

1. Adds a low-speed vehicle used for group travel service for hire to the definition of “shuttle vehicle.”

 

2. Replaces the term “neighborhood electric vehicle” with “low-speed vehicle,” adopting the statutory definition of “low-speed vehicle.”

 

 Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Section 100-3-14.5 of the code is created to read:

 

100-3 Definitions.

 

14.5.                      PASSENGER-CARRYING CAPACITY means the seating capacity of the vehicle which has been specified by the manufacturer, or established by the department of public works upon visual inspection of the vehicle.

 

Part 2. Section 100-3-25 of the code is repealed and recreated to read:

 

25.  SHUTTLE VEHICLE means a privately owned vehicle which is solely engaged in the business of carrying passengers in either a:

 

a. Shared ride service for hire on a fixed route and fixed schedule to and from predetermined locations; or

 

b. Group travel service for hire, provided that the vehicle:

 

b-1. Operates on a pre-reserved basis only and has a passenger-carrying capacity of 5 or more persons, excluding the driver; or

 

b-2. Is a “low-speed vehicle,” as defined in 340.01(27h), Wis. Stats., and is titled and registered by the state as a low-speed vehicle.

 

Part 3. Section 101-51-0 and 1 of the code is repealed and recreated to read:

 

101-51. Use of Low-speed Vehicles On City Streets.

 

1. “Low-speed vehicle” means a motor vehicle that conforms to the definition and requirements for low-speed vehicles as adopted in the federal motor vehicle safety standards for low-speed vehicles under 49 CFR 571.3(b) and 571.500. Low-speed vehicle does not include a golf cart, as defined in s. 340.01(27h), Wis. Stats.

 

Part 4. Section 101-51-2-0 of the code is amended to read:

 

2. REQUIREMENTS. [[Neighborhood electric vehicles]] Low-speed vehicles shall be 4-wheeled and have a speed range of at least 20 miles per hour and not more than 25 miles per hour on a paved surface, and have a [[curb vehicle weight at rest of less than 4,000 pounds]] gross vehicle weight rating that is less than 3,000 pounds. [[Neighborhood electric vehicle does not include an electric golf cart and]] Low-speed vehicles shall have:

 

Part 5. Section 101-51-3 to 6 of the code is amended to read:

 

3. LICENSE. [[Neighborhood electric vehicles]] Low-speed vehiclesshall be registered, titled and licensed by the state of Wisconsin.

 

4. PERMITTED USERS. To use a [[neighborhood electric vehicle]] low-speed vehicle on the streets of the city of Milwaukee, the operator shall have a valid Wisconsin driver’s license.

 

5. PERMITTED USE. [[A]] Under the authority of s. 349.26, Wis. Stats., a licensed individual may operate a [[neighborhood electric vehicle]] low-speed vehicle  on those city streets having a posted speed limit of 35 miles per hour or less, and headlamps must be on during operation

 

6. OPERATION. The operation of [[neighborhood electric vehicles]] low-speed vehiclesas permitted herein shall in all respects be in compliance with ch. 101.
